Personal report to 'European Commission against Racism and Intolerance' re. German government agency Jobcenter Munich

Dear Sir or Madam,

We, my daughter and I, have read your ECRI REPORT ON GERMANY (fifth monitoring cycle) 2014 with great interest and would like to relate our story and experience gained in Germany. A story we would not have considered to be possible. All purpetrated by the German government agency Jobcenter Munich (1) and, not to be outdone, with an absolute disregard of the German labor minister Andrea Nahles, the German Ministry of Education and last but not least the the Ministry of Family Affairs. In all this aided by the notorious court of justice in Munich.

Before we relate our story let us introduce ourselves. I've lived a long time in South Asia and my now 19-year-old daughter was born there by her Asian mother. So according to the rather crude German nomenclature, surprisingly coined by the Federal Statistical Office, she counts as a 'migrant'. Segregating people has always been a historically proven domain of the Germans.

In all those years in Asia we have been living peacefully among Hindu, Muslim, Buddhists and people of other beliefs. Nobody took exception to our clothing or looks. Strangely though, on coming to Germany we did not experience that 'Arcadia' feeling a famous German poet had back then. We are absolutely lost for words, in the literal sense, how a subject like a headscarf can get a people so agitated and become a matter of the highest court.

Segregation continued throughout school for my daughter. We know many kids from families in South Asia who emigrated to the USA and Canada and integration there is pretty straightforward. None of this can be said about Germany and these emigrated families would be in the lowest strata of society, had they chosen to go to Germany. Over there quite a few own houses and their kids attend college.

During my daughter's years in school absolutely nobody outside of school took any interest in her. The local Jobcenter has never enquired about her and nobody has ever seen her. The Jobcenter even refuses to pay for school transportation.

However that complete neglect was to change as soon as my daughter had joined a FOS (Fachoberschule) in Munich in fall 2013 to gain her baccalauréat. She immediately attracted the attention of that government agency Jobcenter that is charged with guaranteeing a constant supply of cheap labor for German factories, so that these can continue setting yet another export surplus for Germany. Staff of this agency break the law, are being connived into luring kids away from an education and exploit the legal inexperience of these young people with abandon. School education in Germany is caste-oriented. You are low, you are expected to get into a job soon. 

So unsurprisingly six months into her first school year at the FOS she received a letter - I was literally waiting for it - from a Jobcenter staff on March 5, 2014 demanding to see her half-term marks sheet. There is no legal basis for this demand. I pretended not quite understanding the purpose and inquired with this this guy from the 'Jobcenter Munich - Job placement U25' (!).

His answer took me by surprise in that it was a mixture of discriminating insinuation ("whether your daughter will successfully complete this school year"), blatant assumption of some form of stupidity ("if she might need private lessons") and topped off by a sycophantic offer to "help her sign up with the jobs portal Jobboerse" of the German Federal Labor Agency "because that is important to get job offers". I was speechless how this could possibly be put into writing by a government agency.

I published these details in four posts on my blog 'meinjobcenter.blogspot.com'. In one blog post I used a picture of nazi Heinrich Himmler with swastika together with a very pertinent quote about schooling he had once made.

In May 2014 I was sued by the deputy managing director of the Jobcenter Munich (2). The Munich court went happily along and started prosecuting me based on article 86a STGB, although the German media and TV are full of nazi images with swastikas. In all court hearings the court inquired if this blog post was still online.

To add insult to injury the city of Munich had clandestinely shut down the anti-discrimination office AMIGRA as I was to discover in February 2015. This prevented me from filing a complaint and following suit against the criminal government agency Jobcenter Munich which in 2012 infringed on my right to free speech and was aided in this by the infamous court of justice of Munich with the confiscation of my computer. The court had actually planned to impound ALL of our IT equipment!

The city of Munich showed an abominable way in its handling of the closure of AMIGRA. It started with AMIGRA not responding to four complaint emails sent by me in 2014 and followed by the City of Munich, who did not respond to two complaint emails in the same matter.

As if this primitive handling was not enough, Munich showed its utter disregard when I made a phone call to the AMIGRA office in February 2015 and a certain Ms Kiermeier picked up the phone and told me, I could send a complaint email to AMIGRA. My email to AMIGRA the next day was answered with an unsigned response from the city of Munich saying that the AMIGRA office had been shut down in May 2014!

My daughter has three court cases running against the criminal Jobcenter Munich in her first year of coming of legal age. 

We are planning to file two charges each against the responsible directors of the Jobcenter Munich once we have the name/s.
