Peirce's Theory of Signs

The sign

In one of his many definitions of a sign, Peirce writes:
I define a sign as anything which is so determined by something else, called its Object, and so determines an effect upon a person, which effect I call its interpretant, that the later is thereby mediately determined by the former. (EP2, 478)
What we see here is Peirce's basic claim that signs consist of three inter-related parts: a sign, an object, and an interpretant. For the sake of simplicity, we can think of the sign as the signifier, for example, a written word, an utterance, smoke as a sign for fire etc. The object, on the other hand, is best thought of as whatever is signified, for example, the object to which the written or uttered word attaches, or the fire signified by the smoke. The interpretant, the most innovative and distinctive feature of Peirce's account, is best thought of as the understanding that we have of the sign/object relation. The importance of the interpretant for Peirce is that signification is not a simple dyadic relationship between sign and object: a sign signifies only in being interpreted. This makes the interpretant central to the content of the sign, in that, the meaning of a sign is manifest in the interpretation that it generates in sign users. Things are, however, slightly more complex than this and we shall look at these three elements in more detail.

The Object

Just as with the sign, not every characteristic of the object is relevant to signification: only certain features of an object enable a sign to signify it. For Peirce, the relationship between the object of a sign and the sign that represents it is one of determination: the object determines the sign. Peirce's notion of determination is by no means clear and it is open to interpretation, but for our purposes, it is perhaps best understood as the placing of constraints or conditions on successful signification by the object, rather than the object causing or generating the sign. The idea is that the object imposes certain parameters that a sign must fall within if it is to represent that object. However, only certain characteristics of an object are relevant to this process of determination. To see this in terms of an example, consider again the case of the molehill.

The sign is the molehill, and the object of this sign is the mole. The mole determines the sign, in as much as, if the molehill is to succeed as a sign for the mole it must show the physical presence of the mole. If it fails to do this, it fails to be a sign of that object. Other signs for this object, apart from the molehill, might include the presence of mole droppings, or a particular pattern of ground subsidence on my lawns, but all such signs are constrained by the need to show the physical presence of the mole. Clearly, not everything about the mole is relevant to this constraining process: the mole might be a conventional black color or an albino, it might be male or female, it might be young or old. None of these features, however, are essential to the constraints placed upon the sign. Rather, the causal connection between it and the mole is the characteristic that it imposes upon its sign, and it is this connection that the sign must represent if it is to succeed in signifying the mole.

The Interpretant

Although there are many features of the interpretant that bear further comment, here we shall mention just two. First, although we have characterized the interpretant as the understanding we reach of some sign/object relation, it is perhaps more properly thought of as the translation or development of the original sign. The idea is that the interpretant provides a translation of the sign, allowing us a more complex understanding of the sign's object. Indeed, Liszka (1996) and Savan (1988) both emphasize the need to treat interpretants as translations, with Savan even suggesting Peirce should have called it the translatant (Savan 1988, 41). Second, just as with the sign/object relation, Peirce believes the sign/interpretant relation to be one of determination: the sign determines an interpretant. Further, this determination is not determination in any causal sense, rather, the sign determines an interpretant by using certain features of the way the sign signifies its object to generate and shape our understanding. So, the way that smoke generates or determines an interpretant sign of its object, fire, is by focusing our attention upon the physical connection between smoke and fire.

For Peirce, then, any instance of signification contains a sign-vehicle, an object and interpretant. Moreover, the object determines the sign by placing constraints which any sign must meet if it is to signify the object. Consequently, the sign signifies its object only in virtue of some of its features. Additionally, the sign determines an interpretant by focusing our understanding on certain features of the signifying relation between sign and object. This enables us to understand the object of the sign more fully.

Although this is a general picture of Peirce's ideas about sign structure, and certain features are more or less present, or given greater or lesser emphasis at various points in Peirce's development of his theory of signs, this triadic structure and the relation between the elements is present in all of Peirce's accounts. In what follows, we shall see three of Peirce's attempts at giving a full account of signs and signification, the corresponding sign typologies, look at the transitions between these accounts, and examine some of the issues that arise from them.

Sign-Vehicles

Recall that Peirce thought signs signify their objects not through all their features, but in virtue of some particular feature. By 1903, for reasons related to his work on phenomenology, Peirce thought the central features of sign-vehicles could be divided into three broad areas, and consequently, that signs could be classified accordingly. This division depends upon whether sign-vehicles signify in virtue of qualities, existential facts, or conventions and laws. Further, signs with these sign-vehicles are classified as qualisigns, sinsigns, and legisigns respectively.

Examples of signs whose sign-vehicle relies upon a quality are difficult to imagine, but a particularly clear example, used by David Savan, is this:
[…] I use a color chip to identify the color of some paint I want to buy. The color chip is perhaps made of cardboard, rectangular, resting on a wooden table etc., etc. But it is only the color of the chip that is essential to it as a sign of the color of the paint. (Savan 1988, 20)
There are many elements to the colored chip as a sign, but it is only its color that matters to its ability to signify. Any sign whose sign-vehicle relies, as with this example, on simple abstracted qualities is called a qualisign.

An example of a sign whose sign-vehicle uses existential facts is smoke as a sign for fire; the causal relation between the fire and smoke allows the smoke to act as a signifier. Other cases are the molehill example used earlier, and temperature as a sign for a fever. Any sign whose signvehicle relies upon existential connections with its object is named, by Peirce, a sinsign.

And finally, the third kind of sign is one whose crucial signifying element is primarily due to convention, habit or law. Typical examples would be traffic lights as sign of priority, and the signifying capability of words; these sign-vehicles signify in virtue of the conventions surrounding their use. Peirce calls signs whose sign-vehicles function in this way legisigns.

Interpretants

As with the sign-vehicle and the object, Peirce thought we could classify signs in terms of their relation with their interpretant. Again, he identifies three categories according to which feature of the relationship with its object a sign uses in generating an interpretant. Further, as with the classification of the sign in terms of the sign-vehicle and the object, Peirce identifies qualities, existential facts, or conventional features as the basis for classifying the sign in terms of its interpretant. ...

Richterin Basslers interessiert verquere Auslassung "es ist bei dem Bild auch nicht erkennbar, dass sich der Angeklagte eindeutig gegen den Nationalsozialismus ausspricht" wäre auch bei diesem Beispiel wie beim Marissa Mayer Meme ein typischer ignoratio elenchi. Simpler und überzeugender kann man es auch beeindruckende und hintertriebene Idiotie nennen.


Memes as Visual Rhetoric

The visual rhetoric approach combines elements of the semiotic and discursive approaches to analyze the persuasive elements of visual texts. Visual rhetoric understands visual texts as created to construct meaning (Foss, 2004, p. 304). Rhetoric is also considered to be persuasive. Blair (2004) notes that visual arguments have a unique ability to draw viewers into the argument’s construction via the viewer’s cognitive role in completing “visual enthymemes” to fill in the unstated premise (p. 59). Rhetoric relies heavily on stylistic devices—such as metaphor—for persuasive purposes (Kenney, 2002, p. 57). Edwards (2004) examines the manner in which iconic images become a type of metaphor for national sentiment; these images can be recontextualized for “symbolic association ... by metaphor or allegory” (p. 189). By considering memes as discourse and analyzing the semiotic elements in memes, researchers can examine how memes operate as rhetoric. A comparison of the semiotic, discursive and rhetorical approaches can be seen in Table 1.

Memes are more than internet humor; research shows them to function by appropriation and resistance to dominant media messages. By examining how memes can operate in subversive and representational ways, this paper offers scholars a framework for the study of memes as symbolic, persuasive texts. Just as the application of visual rhetoric expands general rhetorical theory by acknowledging “the role of the visual in our world” (Foss, 2004, p. 310), examining memes as a form of rhetoric can expand understanding of the way memes function in a participatory media culture.

Memes in a Digital World: Reconciling with a Conceptual Troublemaker

I suggest looking at Internet memes not as single ideas or formulas that propagated well, but as groups of content items that were created with awareness of each other and share common characteristics. Going back to Dawkins’ original idea—that memes are units of imitation—I find it useful to isolate three dimensions of cultural items that people can potentially imitate: content, form, and stance.

The first dimension relates mainly to the content of a specific text, referencing to both the ideas and the ideologies conveyed by it. The second dimension relates to form: This is the physical incarnation of the message, perceived through our senses. It includes both visual/audible dimensions specific to certain texts, as well as more complex genre-related patterns organizing them (such as lip-synch or animation). While ideas and their expression have been widely discussed in relation to the meme concept, the third—communication-related dimension—is presented here for the first time. This dimension—which relates to the information memes convey about their own communication—is labeled here as stance. Expanding Englebertson’s (2007) definitions, I use ‘‘stance’’ to depict the ways in which addressers position themselves in relation to the text, its linguistic codes, the addressees, and other potential speakers. Like form and content, stance is potentially memetic; when re-creating a text, users can decide to imitate a certain position that they find appealing or use an utterly different discursive orientation.

Since I use stance in this context as a very broad category, I wish to clarify it by breaking it into three subdimensions, drawing on concepts from discourse and media studies: (1) participation structures -who is entitled to participate and how, as conceptualized by Phillips (1972), (2) keying -- the tone and style of communication, as defined by Goffman (1974) and further developed by Blum-Kulka et al. (2004), and (3) communicative functions, as conceptualized by Roman Jakobson (1960). Jakobson identified six fundamental functions of human communication, concisely presented as follows: (a) Referential communication, which is oriented toward the context, or the ‘‘outside world’’; (b) emotive, oriented toward the addresser and his/her emotions; (c) conative, oriented toward the addressee and available paths of actions (e.g. imperatives); (d) phatic, which serves to establish, prolong, or discontinue communication; (e) metalingual, which is used to establish mutual agreement on the code (for example, a definition); and (f) poetic, focusing on the aesthetic or artistic beauty of the construction of the message itself.

This analytic framework, consistent with the three memetic dimensions (content, form, and stance),
as well as the three subdimensions of the latter dimension (participation structures, keying, and communicative functions) will be developed and applied in the following section to the analysis of a successful YouTube meme, featuring one somewhat upset fan. ...

To be assimilated, the presented meme must be respectively noticed, understood and accepted by the host. Noticing requires that the meme vehicle be sufficiently salient to attract the host's attention. Understanding means that the host recognizes the meme as something that can be represented in his or her cognitive system. The mind is not a blank slate on which any idea can be impressed. To be understood, a new idea or phenomenon must connect to cognitive structures that are already available to the individual. Finally, a host that has understood a new idea must also be willing to believe it or to take it serious. For example, although you are likely to understand the proposition that your car was built by little green men from Mars, you are unlikely to accept that proposition without very strong evidence. Therefore, you will in general not memorize it, and the meme will not manage to infect you.

Visual communication, including rhetoric and discourse, has been influential to politics and the study of political communication for some time, especially from rhetorical and persuasive perspectives. Abraham (2009) examined editorial cartoons and argued that their visual qualities offer deep reflection on and can orient viewers to social issues. Abraham noted that editorial cartoons’ humor, far from being simple, derives from their ability to deconstruct complex ideas using symbolic images (p. 121). Neuberger and Krcmar (2008) argued that editorial cartoons are politically and ideologically charged, and experimentally demonstrated attitude change in participants who viewed such cartoons. Kjeldsen (2000) described how visual metaphor in a political advertisement could make a host of arguments about a candidate’s fitness for office.

Analysis on Internet Memes using Semiotics

Exzerpt:

Signs, according to Peirce, are “something[s] that represent something[s]” or “refer to a particular meaning”. If the meaning is based on a particular agreement or social convention, that sign is called symbols. So, every phenomenon that exists in the society, whether it is an object, behavior, even a thought, is seen as symbols that ‘represent’ or ‘refer to’ a particular meaning outside/beyond the sign itself.

The color, red, for instance; independently does not mean anything, except the color itself. But, if the color takes part as in culture, for example, is used in traffic lights (representative), then it will also represent “prohibition” (object) in human cognition. For its use in traffic lights, as a representative, the color red is related with ‘prohibition’ (object) is a result of social convention and even international convention.

Those who don’t understand the social conventions will not see the color ‘red’ that represents the meaning of ‘prohibition’. In Medan, Indonesia, a red flag means that ‘someone died’ (object). While in other places, a sign that represents a similar meaning is a yellow flag in Jakarta, and a white flag in Center Java. Those examples show how signs are cultural phenomenons that are bound to particular social conventions.

In relation to all, all natural and biological phenomenons can be seen as symbols. To those who believe, in a particular social convention, natural disasters (representative) are seen as symbols that refer to a meaning that says ‘God’s Wrath’ (object). A twitch on someone’s palm (representative) would mean symbols meaning he or she ‘is about to receive fortune’ (object). Some symbols and their meanings in Javanese Primbon that are usually taken from daily activities, or taken because a respected figure does or believe a certain value, are based on social conventions. Our society even calls it as a sign (either good or a bad sign). Meaning, all examples above are social and cultural phenomenon.

Those who do not participate in the social conventions and are not included in the related cultural environment, would not be able to understand of what was represented by a particular cultural or natural phenomenon. In other words, they will not be able to understand the meaning that exist on the phenomenon, or understand it along with the convention that it follows.

According to Peirce, signs exist because of a process that he called semiosis. This process starts with the insertion of an element of sign that exists on ‘outside’ into human’s senses, which is representative or ground, that might be compared Saussure’s signifier. If the process using our senses has already happened, then the next process inside human cognition process is a referencing of what is called object, which is a matter (meaning) that is represented by representative. For example, when we see a red light, because we already know the valid convention, the red light is considered to refer to a meaning ‘prohibition’ (object), which we may compare it to Saussure’s signified.

The next process is called interpretant, which when we create an interpretation related with the situation that we are in right now. If the red light is located on the streets as  a road sign while we’re driving a car, we will interpret it as a law obligation to stop and then we will interpret it as a permission to proceed by law if the light changes into green. Interpretan affects our behavior during a particular situation. 

The process of interpreting a sign’s meaning from representative, objects and interpretan that is called ‘semiosis’ happens really fast inside our mind. Because of what actually sensed is representative, often times representative is called a sign. It is interesting that Peirce saw the semiosis as a never-ending continous process (unlimited process). He thought that interpretans can be received by our mind and seen as a new sign, or a new representamen. Meaning, a red light that has been interpreted by human’s cognition is extended into a new representamen, for instance it becomes a ‘prohibition’ sign that refer as ‘sanctions for violators’ which then creates an interpretan as a law/prohibition that must not be violated. 

Then, the new interpretan transforms into even newer representamen, for example becoming ‘a heavy financial sanction’ that creates another interpretan a sanction that would make us not afford to pay. This is how semiosis continues without an end.

Constructing, and in some cases deconstructing, seemingly simple images is key to understand the nuances of adolescent communication. Dann haben die Clowns aus Karlsruhe zwei verschiedene Entscheidungen.
"Conceptual integration or blending occurs in a wide range of mental phenomena such as metaphors and, particularly of interest to the subject of this paper, humor. Researchers have shown that conceptual blending plays a vital role in various types of humor including political cartoons (Coulson, in press) and spontaneous humor found in talk radio (Coulson, 2005). "As already mentioned, it is believed (Coulson 2002, Marín-Arrese 2003) that the incongruity produced in the blend is the key element in the creation of humour. In addition, it can also be claimed that this is a characteristic of humorous blends only. However, what all blends have in common are backward projections from the blend into input spaces (Fauconnier and Turner 2002). It is believed that this cognitive operation is a decisive element in the resolution of humour. In that sense, Marín-Arrese (2003) claims that “[t]he problem solving or resolution of the incongruity is realised by projecting backward to these input spaces ...”. Therefore, to resolve the incongruity, the reader has to unpack the blend, that is, to reconstruct the whole integration network. As Fauconnier and Turner (2002, 333) claim, the reader first recognises the incongruity which then prompts him to reconstruct the input spaces. 

Furthermore, Coulson (2002) finds that the emergent structure in the blend can promote the construals in the input spaces by projecting from the blended space to input spaces. In a series of papers, Coulson (1996, 2002, 2005, 2006) discusses jokes and political cartoons providing evidence that humorous blends, with bizarre concepts arising in the blended space, can promote certain aspects of reality. “Political cartoons and rhetorically motivated discourse prompt us to construct blended cognitive models and, in effective cases of rhetoric, desired inferences are analogically projected from blatantly unrealistic blended cognitive models to the real-world target domain” (Coulson 2006, 197-8). Therefore, backward projections from the blended space to input spaces reinforce construals in input spaces in accordance with the new structure created in the blend. 

In that sense, it can be claimed that unrealistic scenarios arising in the blended space often have argumentative potential. In a series of papers Coulson and associates (Coulson 2006, Coulson and Oakley 2006, Coulson and Pascual 2006, Oakley and Coulson 2008) discuss blending and its rhetorical potential. These papers find that conceptual integration as a basic cognitive mechanism can be used as a rhetorical tool influencing the audience to change the reality and even act upon it. Furthermore, analysing blending in persuasive discourse, Coulson and Pascual (2006) find that conceptual integration of two scenarios in a single absurd scenario in the blended space presents an effective argumentative tactic. Although such blends are not constructed in order to be entertaining, creative, and humorous but in order to convince the addressee to change the current state of affairs or to persuade the addressee to change his or her convictions, what these blends and humorous blends have in common are unrealistic scenarios created in the blended space."

EGMR Beschwerde - Anzeige wg. Internet Meme durch Beamten & Nützlichen Idioten Jürgen Sonneck unter Angabe eines falschen Namens. Gedeckt von Münchner Polizei und verrotteter Münchner Justiz

Gestern am 29. Okt. 2018 ging meine Beschwerde an den EGMR. Wegen Schnullifuzzi Jürgen Sonneck und seiner arschgefickten Anzeige unter Angabe des falschen Namens "C. Paucher". Alles fein säuberlich, wie im stinkend korrupten Bayern üblich, gedeckt durch die Münchner Polizei und den Kangaroo Court München.

Warum wählte dieser Nützliche Idiot den Namen "C. Paucher", wo sich doch ganz andere anbieten, sofern man nicht im Mief der Bauerntrampel-Provinz geistig verhaftet ist? Art Vandelay hat doch mondänen Klang oder Dr Martin van Nostrand von der Hoffermandhoffneir Clinic in Belgium. Dat ist eben dat Problem, wenne nur noch 78 Haare uffem Kopp hast wie der Jürgen.

E. Darlegung des Sachverhalts

Strafgerichtliche Verurteilung wegen des Verwendens von Kennzeichen einer verfassungswidrigen Organisation in einem Meme:

Von 1990 bis zum 18.10.2005 lebte der Beschwerdeführer (im Folgenden 'Bf.') in Nepal bei der dortigen lokalen Gemeinschaft mit einer Vielzahl unterschiedlicher Ethnien. Nach seiner Rückkehr nach Deutschland machte sich der Beschwerdeführer nach erfolgloser Arbeitssuche im Bereich Home Decor selbständig. Da das Jobcenter alle Einnahmen über € 30,- (!) sofort als Einkommen abzieht, war ein Geschäftsaufbau unmöglich. Als Aufstockung erhielt der Bf. daher Hartz 4. Nach der jüngsten dieser Beschwerde zugrundeliegenden hinterhältigen Aktion einer Online Strafanzeige unter Angabe eines falschen Namens durch den früheren stellvertretenden Geschäftsführer und Beamten des Jobcenter München Jürgen Sonneck gegen ihn, musste er sein Geschäft einstellen. Seine Auseinandersetzungen mit dem Jobcenter München begannen in 2012 unmittelbar mit Beginn seiner Selbständigkeit. Seit Ende 2012 wurde der Beschwerdeführer und damit auch seine Tochter massiv vom Jobcenter München und der Agentur für Arbeit mit bislang drei Strafanzeigen, die in sein Recht der freien Meinungsäusserung eingriffen, attackiert, weil er diesen Blog begonnen hatte, um über seine Erlebnisse mit dem JC im Zuge seines gerade begonnenen Geschäfts zu berichten.

Am 28. Oktober 2015 erschienen gegen 8:45 Uhr zwei Polizisten und eine Polizistin in Zivil und verlangten Einlass unter Vorlage eines Richterlichen Beschlusses (Anlage 3) vom 08. Okt. 2015, der nicht vom Richter unterschrieben war. Ein männlicher Polizist stürzte sofort auf die Tür zum Zimmer der Tochter des Bf. und riss sie auf, ohne anzuklopfen. Die Tochter des Bf. war jedoch schon in der Schule. Im Verlauf wurde der Bf. körperlich durchsucht und es war offensichtlich, dass die Polizistin für die körperliche Durchsuchung seiner Tochter abgestellt war. Die Wohnung wurde fotografiert und auch das Haus von aussen. Es wurde die komplette IT-Ausrüstung inklusive Router beschlagnahmt, denn einem Blogger musste jeder Zugang zum Internet genommen werden. Dies war die zweite Computerbeschlagnahme nach 2013 (damals für 25 Monate ohne finanzielle Entschädigung!) ebenso aufgrund einer Strafanzeige durch eine Münchner Arbeitsbehörde. Obwohl die Beschlagnahme des Smartphones nicht im Beschluss angeordnet war, wurde auch dies beschlagnahmt (Anlage 5). Selbiges war zweifellos mit dem Smartphone seiner Tochter geplant.

Akteneinsicht im April 2016 ergab, dass am 07. Mai 2015 eine Online Strafanzeige kurz vor 20 Uhr an die Polizei München Kriminalfachdezernat 4 gegen den Bf. unter Angabe eines falschen Namens "C. Paucher" gesandt worden war (Anlage 4, S. 2). Auffällige, chronologische Indizien inkl. IP-Adresse engten den Täterkreis sofort ein auf das Jobcenter (Extra Anlage ‘Jürgen Sonneck Indizien’). Die Online Anzeige sieht Hetzrede in einem Blog Post (Anlage 1), der vom November 2014 (!) stammt und ein Meme der damaligen Geschäftsführerin von Yahoo Marissa Mayer (Anlage 2) zeigt. Es ist ein photogeshoptes Bild von M. Mayer, gekleidet in Nazi Uniform mit Swastika mit einem applizierten Text "Work from Home? Nine!". Das Bild war hier zu sehen: http://www.classicforwards.com/memes/marissa-mayer-work-home-meme/ und ist mittlerweile auf Pinterest zu sehen (Anlage 2). Es wurde in dieser Form vom Bf. in 2014 heruntergeladen. Die Münchner Gerichte haben offensichtlich das Wesen von Memes nicht verstanden. Nach Dictionary.com ist ein Meme “1. an element of a culture or system of behaviour passed from one individual to another by imitation or other non-genetic means. 2. an image, video, piece of text, etc., typically humorous in nature, that is copied and spread rapidly by Internet users, often with slight variations.” Nach Wikipedia ist ein "... Internet meme, commonly known as just a meme, ... an activity, concept, catchphrase, or piece of media that spreads, often as mimicry or for humorous purposes, from person to person via the Internet.” Dawkins definierte es in seinem Buch 'The Selfish Gene' als “the basic unit of cultural transmission, or imitation”. Bei 'Vice' heisst es: "You can't make a meme. The meme part is the phenomenon, and is a function of the network into which it is placed”. Eines der bekanntesten Memes zur Zeit ist "Is this a pigeon?", obwohl ein Schmetterling gezeigt wird. 'Vox' erklärt es u.a. so: "But “Is it a pigeon?” and its cousins may be serving as a counter to the American Chopper meme because they allow the meme creator to frame an issue completely through the static image they're

presenting. And, crucially, the “misunderstanding” at the center of this meme can be deliberate, accidental, disingenuous, or ironic. That allows us to comment on all manner of social trends and flaws within ourselves and others."

Das M. Mayer Meme bezieht sich auf eine Entscheidung des Yahoo CEO, die bis dahin geltende Möglichkeit der Arbeit von daheim zu beenden. "Nine" steht zum einen für 'Nein' bzw. den nine to five job. Das Wort 'Nine' wurde auch benutzt in Anspielung auf die typisch deutsche sture und strikte Art. Die Nazi Uniform ist ein offenkundiges Vehikel zur optischen Übersteigerung und hat nichts mit Propaganda zu tun. Yahoo ist eine amerikanische Medienfirma und nicht bekannt als Proponent des Nationalsozialismus. Der Text des Blog Posts handelt von freier Meinungsäusserung und Gerichten in einem demokratischen Staat. Der Nationalsozialismus hatte nie etwas mit freier Meinungsäusserung zu tun und Frauen trugen nie eine derartige Nazi-Uniform. Es ist eine offensichtliche Juxtaposition. Den Blog Post als Hetzrede zu denunzieren oder wie im Polizeibericht als Teil "Rachefeldzugs" (Seite 3), ist abstrus und böswillig.

Die Polizei ging der IP Adresse nicht nach, schnüffelte aber ausgiebig auf dem Blog des Bf. (siehe Polizeibericht Anlage 4). Polizist Carstens erklärte auf Befragung während der Verhandlung vor dem LG München am 15. Feb. 2017, IP Adressenermittlung sei zu aufwendig. Dieses einseitige Ermittlungsverfahren verstösst gegen § 160 Abs. 2 StPO und insbesondere § 163b StPO Maßnahmen zur Identitätsfeststellung. Ein Brief an Richterin Pabst vom 26. April 2016 (Anlage 7), eine richterliche Anordnung zur Herausgabe des Namens und der Adresse des Inhabers der IP Adresse  217.253.91.237 unter  Berufung  auf § 100g Strafprozessordnung zu erlassen,  blieb unbeantwortet. Damit wurde dem Bf. die Möglichkeit der Befragung des Anzeigenden gemäss Art. 6 Abs. 3 d EMRK genommen. Der Polizeibericht ist eindeutig parteilich abgefasst.

Der Computer seiner Tochter wurde von der Münchner Justiz mutwillig (!) beschädigt (deutliche Kratzer im linken unteren Viertel des Bildschirms sowie defektes Trackpad) zurückgegeben. Da er unbrauchbar war, hat der Beschwerdeführer ihn im Januar 2017 an das Bundesministerium f. Arbeit und Soziales  BMAS geschickt. Das MacBook wurde beschlagnahmt, obwohl ihn die Tochter für die Schule benötigte. Der damalige Anwalt des Bf. der Verhandlung vor dem LG München am 06. Mai 2015 im Fall, der dem EGMR mit Beschwerde Nummer 35285/16 vorlag, warnte im Beisein der Tochter des Bf. wörtlich, sollte der Blog weitergeführt werden, "machen die Sie fertig". Gemeint war die Justiz.

Zur Beschlagnahme des Smartphones OHNE Richterlichen Beschluss sandte der Bf. im Januar 2017 eine Beschwerde an den Polizeipräsidenten von München (Anlage 15). OStAin Tilmann vom OLG München verwies in ihrem Antwortschreiben vom 01.06.2017 (Anlage 16) auf eine Stellungnahme mit Az. 120 Js 119571/17. Dem Bf. liegt kein Schriftverkehr mit diesem Aktenzeichen vor.

Am 21. April 2016 erhob die Staatsanwaltschaft München I Anklage gegen den Bf. wegen des Verwendens von Kennzeichen nationalsozialistischer Organisationen in zwei Fällen sowie Beleidigung von Richterin Pabst (Anlage 6). Am 22. Juni 2016 verurteilte das AG München den Bf. zu einer Gesamtgeldstrafe von 290 Tagessätzen à € 10,- gleich € 2.900,- (Anlage 10). Der Bf. hatte vorher Befangenheitsantrag gestellt (Anlage 8), der abgelehnt wurde (Anlage 9). Richterin Birkhofer-Hoffmann zeigte wieder das gleiche aggressive Verhalten wie in einer Verhandlung ein Jahr zuvor und drückte im Abschlussplädoyer ihr Missfallen über den Befangenheitsantrag aus. Weiters weigerte sich Richterin Birkhofer-Hoffmann standhaft, die Tochter des Bf. als Zeugin dem Prozess beiwohnen zu lassen. Erst als er sehr laut wurde - seine Tochter bestätigte ihm damals dies draussen deutlich vernommen zu haben -, wurde sie zugelassen. Den Höhepunkt bildete ihre Feststellung, EGMR Entscheidungen gelten nicht in Deutschland, nur deutsches Recht.

Zwar hob das LG München, vertreten zum dritten (!) Mal durch Richterin Baßler, das Urteil am 15. Februar 2017 zum überwiegenden Teil auf (Anlage 13) und entschied auf eine Geldstrafe von 50 Tagessätzen à € 10,- für die Veröffentlichung des Marissa Mayer Memes, doch drückte der Bf. zuvor seine begründete Besorgnis der Befangenheit von Richterin Baßler aus und sah ihre Unparteilichkeit basierend auf früheren Erfahrungen als auch unter Berufung auf die Entscheidung des EGMR im Fall 'FERRANTELLI AND SANTANGELO v. ITALY  (Application no. 19874/92) und die Sätze 58 bis 60 der Entscheidung des EGMR ("double circumstance") als nicht gegeben an. Die Sitzung wurde für etwa 40 Minuten unterbrochen und nach Aushändigung des Beschlusses von Richterin Hansen (Anlage 12) fortgeführt. Der Inhalt des Beschlusses ist gelogen, denn laut eines Beschlusses des BGH vom 8.2.2017 (1 StR 493/16) existierte beim LG München I für das Schwurgericht für die Jahre 2012, 2014 und 2015 zumindest zeitweise kein gültiger Geschäftsverteilungsplan! Es mutet seltsam an, wenn bei einem GVP für einen Angeklagten, der in allen drei Fällen von Arbeitsbehörden angezeigt

wurde, das "Losglück" der Richterzuweisung über vier Jahre hinweg immer auf die gleiche Richterin fällt.

Keiner der Zeugen zur Vernehmung des Bf. wurde geladen (Anlage 11)! Als explizit dringend Tatverdächtigen hatte der Bf. Jürgen Sonneck geladen. Damit wurde der Bf. wiederum in seinem Recht auf Waffengleichheit, ein wesentlicher Bestandteil der Konvention, beschnitten. Der Vorwurf der einseitigen Ermittlungen (siehe § 160 Abs. 2 und § 163 STPO), sowie Verweise auf Fälle des EGMR wie Rachdad gg. Frankreich (Beschwerde Nr. 71846/01) bei dem die Pflicht, Zeugen ausfindig zu machen entschieden wurde, werden im Urteil nicht erwähnt.

Der Behauptung des Gerichts im Urteil unter 'V. Rechtliche Würdigung' (Anlage 13), "es ist bei dem Bild auch nicht erkennbar, dass sich der Angeklagte eindeutig gegen den Nationalsozialismus ausspricht", fehlt es an jeglicher Rationalität und zeigt, das Gericht hat die Funktion und Essenz eines Memes überhaupt nicht verstanden und verstehen wollen.

Weiters führt das Gericht in der 'Rechtlichen Würdigung' die "Tabuisierung" von NS Symbolen an und verweist auf Fischer, Kommentar zum Strafgesetzbuch, zu § 86 a. Randnummer 2 a. Richterin Baßler liess bewusst wichtige Ausführungen von Thomas Fischer aus. Unter 2a (Fischers 63. Auflage) heisst es: "Dient der Tatbestand dagegen der inhaltlichen Ausgrenzung verfassungswidriger Bestrebungen im  Vorfeld organisierter Propagierung (Propagandaverbot), so müsste jede, auch eine inhaltlich indifferente oder neutrale Verwendung vom Tatbestand ausgenommen werden. Umgekehrt ließe die Durchsetzung eines sinnfreien Tabus inhaltlich begründete Ausnahmen („legitime Zwecke“ insb. der „Auseinandersetzung“; vgl. Abs. III) nicht zu.” Siehe auch 2 b bei Fischer: "Auch nach seinem Wortlaut folgt § 86a dem Tabuisierungs-Konzept wenn man nicht die Begriffe „verwenden“ und „verbreiten“ in intentionalem Sinn deutet. Hieraus folgen besondere Schwierigkeiten der Anwendung. Eine vom Äußerungs- und Handlungskontext abstrahierende Tabuisierung von Zeichen oder Worten kann unter den Bedingungen einer Gesellschaft kaum als legitim gelten, die Legitimität gerade auch aus der formalen Offenheit der Kommunikation gewinnt."

Wenn das Gericht derart der Tabuisierung und dem Entgegentreten eines Gewöhnungseffekts das Wort reden will, so bleibt dem Bf. die Plethora an NS-Bildern in etablierten (teils zwangsfinanzierten) deutschen Medien ein Rätsel. Anlässlich des Hakenkreuzschnitzel-Falls im ZdF entschied die Staatsanwaltschaft in Mainz im Mai 2016 korrekt wie folgt: "Nach dem vorgetragenen Sachverhalt ist kein Anfangsverdacht für ein strafbares Verhalten gegeben (§ 152 Abs. 2 Strafprozessordnung). Der Inhalt dieses Beitrages und dessen Verbreitung erfüllen keine Strafvorschrift. ...".

Am 06. April 2017 legte der Bf. zu Protokoll der Geschäftsstelle Revision ein (Anlage 14). In deren Rahmen rügte er insbesondere, dass AG und LG München nicht den Anforderungen an ein Gericht laut Art. 6 EMRK genügten und bemängelte die einseitigen Ermittlungen nur gegen ihn, obwohl der Polizei und Staatsanwaltschaft die IP-Adresse des unter falschem Namen Absendenden bekannt war. Hierzu verfasste die Generalstaatsanwaltschaft München am 13.09.2017 den Antrag, die Revision zu verwerfen (Anlage 17). Unter Punkt II 1 a bemängelte sie eine fehlende Verfahrensrüge, die den Anforderungen des § 344 Abs. 2 Satz 2 genügt. Diese erfolgte sehr wohl durch den Bf. in seiner Revisionsbegründung in den Punkten 1.1.1. und 1.1.2., ebenso 1.1.5. bis 1.1.8. und 2.1.1. bis 2.1.10. Am 23. September 2017 nahm der Bf. Stellung (Anlage 18) und wies OStA Weiß zurecht, als ihm die durch Richter über die Jahre vorgetragenen Lügen zu viel wurden und offenkundig in der Münchner Justiz Hartz 4 Rezipienten als intellektuell Retardierte angesehen werden, denen alles aufgetischt werden kann. Der Bf. ist fassungslos, wie ein studierter Jurist wie OStA Weiß folgenden Zirkelsatz angesichts des Memes verfassen kann: "Die festgestellte Verwendung und Gestaltung der verfahrensgegenständlichen Bilder unter Verwendung von Symbolen der NS-Gewaltherrschaft lässt vielmehr vielgestaltige Interpretationen zu, auch eine Interpretation, die gerade nicht als Distanzierung anzusehen ist." und diesen als Begründung angesehen wissen möchte. Daraufhin beschloss das Oberlandesgericht München am 10. Januar 2018 (Anlage 19) die Revision gegen das Urteil des Landgerichts München I als unbegründet zu verwerfen.

Am 01. Feb. 2018 reichte der Bf. fristgerecht Verfassungsbeschwerde (Anlage 20) ein. Diese wurde am 08. Juni 2018 nicht zur Entscheidung angenommen (Anlage 21). Schon am 26.01.2016 hatte die Tochter des Bf. vergeblich einen Eilantrag auf Erlass einer einstweiligen Anordnung zur Herausgabe der beschlagnahmten IT-Ausrüstung an das Bundesverfassungsgericht (Extra Anlage 1) gesandt mit dem Az. 2 BvQ 7/17. Ihr Laptop war essentiell für die Schule. Das Bundesverfassungsgericht wies den Antrag am 04. März 2016 ab.

Art. 10 Abs. 1 EMRK (Meinungs- und Pressefreiheit)

Erläuterung

Der Beschwerdeführer ist nach § 86a Abs 1 Nr. 1 Strafgesetzbuch (StGB) verurteilt worden. Die Norm des § 86a StGB richtet sich gegen das Verwenden und Verbreiten nationalsozialistischer Kennzeichen sowie Kennzeichen anderer politischer Parteien und Vereinigungen, soweit sie für verfassungswidrig erklärt oder verboten worden sind.

Die Norm schützt nach der herrschenden Meinung In Deutschland als abstraktes Gefährdungsdelikt sowohl den demokratischen Rechtsstaat vor einer Wiederbelebung verfassungswidriger Organisationen und vor Ihrer "Verharmlosung" durch Gewöhnung an bestimmte Kennzeichen als auch den politischen Frieden und damit auch das Ansehen der Bundesrepublik Deutschland Im Ausland. Die Durchsetzbarkeit des intendierten Schutzes erfolgt in der deutschen Rechtsprechung durch eine Tabuisierung der Kennzeichen in Form einer umfassenden Verbannung aus der Öffentlichkeit, so dass die subjektive Beziehung des Kennzeichenverwenders grundsätzlich ohne Bedeutung ist und auch eine ablehnende oder neutrale Verwendung den Tatbestand des § 86a StGB erfüllt. Eine solche weitgehende Auslegung der Norm zulasten der Rechte aus Art 10 Abs 1 EMRK Ist nicht "in einer demokratischen Gesellschaft notwendig" und konventionsrechtswidrig, da der intendierte Rechtsgüterschutz auch erreicht werden kann, indem nur eine inhaltliche Identifizierung mit dem Gehalt des Kennzeichens unter Strafe gestellt wird. Nach der Konvention darf eine Verurteilung nur dann erfolgen, wenn die Verwendung nach den konkreten Umständen als Bekenntnis des Täters zu den inhaltlichen Zielen der Organisation aufgefasst werden kann. Das Rechtsgut des politischen Friedens ist erst dann gefährdet, wenn die Verwendung der verbotenen Symbole bekenntnishaft erfolgt. Nur so lässt sich überdies der Tatsache, dass vom Schutzbereich nicht nur der Inhalt der Äußerung, sondern auch Ihre Form geschützt ist, Rechnung tragen. Ebenso lässt sich nur so dem Interesse des demokratischen Prozesses, für den die Kommunikationsgrundrechte konstitutive Bedeutung haben, hinreichend Rechnung tragen (Propagandaverbot statt Tabuisierung).

Das Marissa Mayer Meme bezog sich auf die kritische wirtschaftliche und geschäftliche Situation der Firma Yahoo.  Die Komik des Memes besteht u.a. darin, dass IT-Firmen die eigentlichen Proponenten  der Arbeit von zu Hause sind. Die NS-Uniform unterstreicht visuell die ultimative Forderung des CEO nach bedingungsloser Konzentration auf das wirtschaftliche Wohlergehen der Firma. Jegliche Unterstellung eines anderen Kontexts oder gar Propaganda wäre abstrus.

Das Landgericht hat seine Entscheidung lediglich damit begründet, dass "es ... bei dem Bild auch nicht erkennbar (sei), dass sich der Angeklagte eindeutig gegen den Nationalismus ausspricht" und "es ergibt sich auch nicht aus dem Kontext der Verwendung, weshalb das Bild der Geschäftsführerin von Yahoo in einer NS-Uniform gezeigt wird". Dabei haben die Gerichte bereits das Wesen von Memes nicht erkannt, als diese nicht nur themenspezifisch, also ursprünglich bei diesem Bild anlässlich der Entscheidung der Beendigung von Heimarbeit bei Yahoo, sondern teils weit themenübergreifend im Internet verwandt werden (siehe Meme 'Is this a pigeon'). Die NS-Uniform fungiert in dem Bild als doppeltes optisches Ausrufezeichen für das "Nine!". Die Frage des Gerichts nach der Funktion der NS-Uniform bei Marissa Mayer kommt einer Bitte gleich, einen Witz zu erklären. Wie Wikipedia erklärt, fungiert ein Meme "als Mimik oder für humorvolle Zwecke". Ausserdem trugen Frauen in der NS-Zeit keine derartigen Uniformen.

Der Verweis des Gerichts auf "Ausgrenzung bestimmter Symbole aus den zulässigen Kommunikationsformen (Tabuisierung) ..., um einem Gewöhnungseffekt vorzubeugen" unterschlägt bewusst wichtige Passagen bei Thomas Fischer: "Aufgrund der besonderen Anforderungen des Grundrechts der Meinungsfreiheit sind aber Ausnahmen geboten, wenn das Verhalten trotz äußerer Verwendung der Kennzeichen dem Schutzzweck erkennbar nicht zuwiderläuft (vgl. BGH 25, 30, 32f.; 25, 133, 136f.; 51, 244 [= NJW 07, 1602; Anm. Schroeder JZ 07, 851; Hörnle NStZ 07, 698]; vgl. unten 18). Diese Rspr. ist mit der Verfassung vereinbar (BVerfG NJW O6, 3052).” Ebenso die Ausführungen Fischers unter 2 b. Erläuterung

Schon am 26. April 2016 sandte der Bf. einen Antrag an Richterin Pabst am Amtsgericht München (Anlage 14), eine richterliche Anordnung zur Herausgabe des Namens und der Adresse des Inhabers der IP Adresse  217.253.91.237 unter  Berufung  auf § 100g Strafprozessordnung zu erlassen. Er belegte seinen Antrag mit acht auffälligen Indizien, die eindeutig auf einen Mitarbeiter des JC schliessen liessen. Die Weigerung den Antrag überhaupt zu beantworten, belegt die Parteilichkeit des Münchner Amtsgerichts. Dem unbeantworteten Schreiben folgten zwei weitere erfolglos am 03. Mai  2016 und am 13. Mai 2016.

Obwohl der Bf. mit Schreiben vom Januar 2017 an das LG München (Anlage 11) u.a. explizit " J. Sonneck (als dringend Tatverdächtiger der Sendung der Email unter falschem Namen basierend auf auffälligen Indizien) Jobcenter München, Orleansstraße 50, 81667 München" geladen hatte, wurde er nicht geladen. Eine scharfe Befragung sowohl von J. Sonneck als auch der damaligen GFin Martina Musati hätte Aufschlüsse über dieses perfide Unterfangen geben können. Polizist Carstens antwortete auf die Frage warum er nicht der Identität hinter der IP-Adresse nachgegangen sei, dies sei zu aufwendig. In Deutschland sind Blogger schuldig ex ante. Die Gerichte unternahmen nicht den geringsten Versuch, den vom Bf. aufgelisteten auffälligen und chronologisch überzeugenden Indizien nachzugehen. Die im Juli 2017 hastig vollzogene Überstellung vom Jobcenter München zum Referat für Bildung und Sport München nach scharfen, eindeutigen und veröffentlichten Kommunikationen des Bf. mit Bundesministerien in Berlin und dem Polizeipräsidenten von München ist entlarvend.

Betreff Art 8 EMRK

Eine Beschlagnahme des Smartphones war im Richterlichen Beschluss vom 08. Oktober 2015 nicht angeführt. Dennoch wurde es von den Polizisten beschlagnahmt und es ist ausserdem davon auszugehen, gleiches war mit dem Smartphone seiner Tochter geplant, da eine Polizistin zugegen war. Trotz Rechtswidrigkeit zeigte sich Richterin Birkhofer-Hoffmann interessiert an dem Auswertungsergebnis. Für Hartz 4 Rezipienten schienen für sie keine Rechte zu gelten.

Das Bundesverfassungsgericht stellte in einem Beschluss vom 04. Februar 2005 - 2 BvR 308/04 unter Rn. 23 bis 25 klare Grenzen für eine Beschlagnahme fest. Am 22. Nov. 2016 reichte der Bf. Strafanzeige gegen Polizist Carstens bei der Staatsanwaltschaft München ein. Weiters sandte er zwei Pdf an den Polizeipräsidenten von München, die von der Polizei laut deren Schreiben vom 26.04.2017 angeblich an die Staatsanwaltschaft gereicht wurde. Dem Bf. liegt kein Schriftverkehr mit dem Az. 120 Js 119571/17 vor, wie von Oberstaatsanwältin Tilmann im Schreiben vom 01.06.2017 und noch einmal bestätigend am 19.10.2017 behauptet wurde. Alles wurde unter den Teppich gekehrt.

Hitler addresses ECHR. Debunks Germany’s “criminal sanctioning of use of Nazi symbols” as virtue signalling deflecting from him having been a true Keynesian

This is in reference to the Case 35285/16 and the ECHR's decision in April 2018. There is among others the salient paragraph 47. Fortunately, someone with first hand knowledge and expertise was only too eager to chip in and get a couple of misconceptions straight.
