Beschwerde gegen Beschluss vom 20.12.2016

Richter Nielsen,

Ich nehme Bezug auf Ihren Beschluss vom 20.12.2016 mit dem Sie meine Forderung nach Wiederaufnahme des Falles im Stile des Ipse dixit einfach mal so bayrisch wegwischen. Sie sollten sich schämen, aber sich schämen zu können, würde voraussetzen, sich bewusst zu sein, was für ein Rott und welche Verkommenheit die bayerische Justiz darstellt. Als Asienbeheimateter (ich bin kein Deutscher ausser der läppischen Geburtsurkunde!) kann ich Korruptheit sehr gut beurteilen. Und es stinkt in Bayern.

Nachdem das nun gesagt werden musste, stelle ich ein eklatantes Manko in Ihrem Beschluss fest. Das Manko Ihrer Redlichkeit, aber elegant ausgeglichen mittels Durchtriebenheit, denn das haben Sie doch vorzüglich hingekriegt, nicht wahr! Will sagen, ich erhalte Ihren Beschluss am 22.12.2016 per Post. Also zwei Tage bevor ein späterer langhaariger Wanderprediger mit billigen Taschenspielertricks avancierend gefeiert wird, und Sie nassforsch eine Frist zur sofortigen Beschwerde auf eine Woche limitieren. Sagen Sie, Richter Nielsen, haben Sie eigentlich in der Provinz Bayern überhaupt keinen Stil? Betteridge lässt grüssen.

Aber Sie wären ja nicht bei der bayerischen Justiz, wenn Sie nicht auch wüssten, was Unterschlagung ist. Da beziehen Sie Ihren Beschluss auf mein Schreiben vom 07.08.2016. Das Schreiben wurde doch von der verrotteten bayerischen Justiz in München wie üblich gar nicht beachtet, so dass ich das gleiche Schreiben noch einmal am 13.10.2016 an die Münchner Justiz sandte. Das wollten Sie natürlich unter den Teppich kehren.

Die gleiche Justiz schützt auch den Verbrecher Manfred Jäger und weigert sich bis heute, ebenso wie die kriminelle Betrügerin und RAin Aglaia Muth, mir die 19 Seiten Dokumente auszuhändigen, die dieser rechtsbrechende Schlawiner Manfred Jäger 2012 an die Polizei sandte, nachdem er in plump-dummer Manier mich um € 10.000,- erpressen wollte und ich nach Lektüre seines lächerlichen Erpresserschreibens nur seine Vollidiotie attestieren konnte.

Wieso erwähnen Sie immerzu der § 359 Abs. 2 STPO??? Auf den hatte ich mich doch gar nicht bezogen. Ich bezog mich auf den § 359 Abs. 6 STPO. Dort heisst es:

6. wenn der Europäische Gerichtshof für Menschenrechte eine Verletzung der Europäischen Konvention zum Schutze der Menschenrechte und Grundfreiheiten oder ihrer Protokolle festgestellt hat und das Urteil auf dieser Verletzung beruht.

Der EGMR hat im CASE OF VAJNAI v. HUNGARY  (Application no. 33629/06), CASE OF HORVÁTH AND VAJNAI v. HUNGARY (Application nos. 55795/11 and 55798/11) und auch im Case FRATANOLÓ v. HUNGARY festgestellt:

1. Strafrechtliche Eingriffe in die Äußerungsfreiheit (Meinungsfreiheit) des Art. 10 EMRK sind nur zulässig, wenn sie einem dringenden sozialen Bedürfnis entsprechen. Auch vor dem Hintergrund der historischen Erfahrungen Ungarns ist ein solches dringendes Bedürfnis bei der schlichten Verwendung eines kommunistischen Propagandasymbols (hier: der „rote Stern“) nicht zu begründen.

2. Die Äußerungsfreiheit des Art. 10 EMRK schützt auch Äußerungen, die beunruhigen, schockieren oder stören. Der Einschränkungsvorbehalt des Art. 10 Abs. 2 EMRK muss gerade im politischen Meinungskampf eng ausgelegt werden.

3. Beim Gebrauch mehrdeutiger Symbole, die auch für totalitäre Auffassungen stehen können, darf dem Äußernden nicht unterstellt werden, dass er das Symbol im Sinne einer Identifikation mit totalitären Auffassungen gebraucht. Es ist eine sorgfältige Prüfung der Äußerung in ihrem Kontext vorzunehmen. Eine Strafnorm, die den Gebrauch mehrdeutiger Symbole pauschal untersagt, ist deshalb zu weitgehend, zumal eine einschränkende Auslegung, die nach der jeweiligen Bedeutung des Symbols unterscheidet, nicht zufrieden stellen kann: Die Unterscheidung würde so unsicher sein, dass ein Einschüchterungseffekt („chilling effect“) und Selbstzensur nicht zu vermeiden wären.

4. Einschränkungen von Menschenrechten dürfen nicht ausschließlich auf gefühlsmäßiger Ablehnung eines Verhaltens beruhen. Die demokratische Gesellschaft muss in ihrem Urteil rational bleiben. Die Äußerungsfreiheit darf nicht wegen befürchteter Gegenreaktionen von vornherein suspendiert sein.

Wo das Dritte Reich damals mit militärischer Macht u.a. gegen das Volk der Griechen vorging, geht Deutschland heute als DAS dominierende Land der faschistoiden EU mit ökonomischer Gewalt vor und unterdrückt wieder das griechische Volk und schafft die grösste Jugendarbeitslosigkeit, die die neuzeitliche Geschichte je gesehen hat. Heutzutage wird Faschismus demokratisch in der Bananenrepublik der Plunse Merkel bewältigt.

Da kommen Sie mit lächerlichen Formfehlern, die nur eine Intention haben: die rücksichtslose Unterdrückung der freien Meinungsäusserung eines Hartz 4 Rezipienten durch knebelnde Geldstrafen, oktroyiert durch eine willfährige Justiz, einer kungelnden RAin und Verbrecherin Aglaia Muth und den sozial-faschistischen Jobcentern (Pflichtlektüre FA Hayek 'The Road to Serfdom' bevor Sie den Mund unreflektiert auf machen, Richter Nielsen).

Das Billiglohnland Deutschland braucht billige Arbeitskräfte und jede Kritik an diesem nonsusteniblen Wirtschaftsmodel muss unterdrückt werden. Wo Hitler damals seine SS einsetzte, um Inflation zu unterdrücken, bewerkstelligt das heutige Deutschland dies mit Lohndeflation durchgesetzt mit sozial-faschistischen Jobcentern operierend unter der Paralleljustiz SGB II.

Sie erdreisten sich, meine zehn dezidierten Punkte, die Pflichtverletzung dieser lächerlichen und mit dem Gericht kungelnden Anwältin Aglaia Muth beschreibend, zynisch beiseite zu wischen. Die dilettantische Anwältin Aglaia Muth wurde von der Münchner Justiz für eine nicht erbrachte Leistung entlohnt. Das ist Betrug und die Münchner Justiz ist Handlanger dieses Betruges. Robert Mugabe in Zimbabwe wäre begeistert und Kim Jong-un würde einen weiteren schweizer Käse anrollen lassen.

Ich garantiere der bayerischen Justiz 300%ig, dass ich Manfred Jäger von der Agentur für Arbeit vor Gericht bekomme. Die verrottete bayerische Justiz schreckt sogar nicht davor zurück, mein Handy OHNE Gerichtsbeschluss beschlagnahmen zu lassen. Sie ist so herunter gekommen, dass sie sogar an das Handy meiner tibetischen Tochter kommen wollte und sie auch einer Körperdurchsuchung in faschistoider Manier unterziehen wollte. Den Beschluss vom 04. Februar 2005 - 2 BvR 308/04 interessiert doch eine solch verkommene Justiz nicht. Warum auch, man unterstellt doch Vollidiotie bei Hartz 4 Pennern.

Am 14.10.2016 sandte ich einen 'Report to EUROPEAN COURT OF HUMAN RIGHTS on relentless infringements of free speech by German Jobcenter in collusion with Munich Court' an den EGMR. Dieser Report wurde in unsere Akte der Beschwerde Nr. 35285/16 aufgenommen. Meine Tochter und ich hoffen, dass unsere Beschwerde zu einer Entscheidung schlussendlich angenommen wird.

Ich fordere hiermit nachdrücklich eine Wiederaufnahme der Verhandlung vor dem AG München, da der Verbrecher Manfred Jäger, Leiter der Agentur für Arbeit Ingolstadt, in mein Recht der freien Meinungsäusserung mehrfach eingriff und er und andere Jobcenter Mitarbeiter offensichtlich von der berüchtigten bayerischen Justiz, einer Justiz mit Neonazi-Affinität (das Simulacrum 'NSU Schauprozess' in München erweckt in mir Erbrechen und ein völlig lächerlicher Oberstaatsanwalt Hummer aus München wagt es, mir Kritik an Geschichtsverfälschungen der Nazizeit in den deutschen Medien zu verbieten.), gedeckt werden und zusammen im Bett sind. Dies mit dem perfiden Ziel, Hartz 4 Rezipienten in faschistischer Manier mundtot zu machen.

Ich werde Ihre Antwort abwartend, die ohehin eine Absage sein wird, diese dann zusammen mit Ihrem Beschluss in kondensierter Form in englischer Sprache für meine Unterlagen zur Einreichung beim EGMR verfassen und selbstverständlich auf meinem Blog veröffentlichen. Ein Blog, den die bayerische Justiz und Polizei mit allen Mitteln zum Verschwinden bringen wollen. Dies wird niemals gelingen. Alles ist abgesichert und es existieren mehrfache Backups weltweit, keiner davon in Deutschland.

Solange ich atme, werde ich mein Recht auf freie Meinungsäusserung voll wahrnehmen.

Do single women avoid career-enhancing actions because these actions could signal personality traits (like ambition) that are undesirable in the marriage market? We answer this question through two field experiments in an elite U.S. MBA program. Newly-admitted MBA students filled out a questionnaire on job preferences and personality traits to be used by the career center in internship placement; randomly selected students thought their answers would be shared with classmates. When they believed their classmates would not see their responses, single and non-single women answered similarly. However, single women reported desired salaries $18,000 lower and being willing to travel seven fewer days per month and work four fewer hours per week when they expected classmates would see their answers. They also reported less professional ambition and tendency for leadership. Neither men nor non-single women changed their answers in response to peer observability. A supplementary experiment asked students to make choices over hypothetical jobs before discussing their choices in their career class small groups; we randomly varied the groups’ gender composition. Single women were much less likely to select career-focused jobs when their answers would be shared with male peers, especially single ones. Two results from observational data support our experimental results. First, in a new survey, almost three-quarters of single female students reported avoiding activities they thought would help their career because they did not want to appear ambitious. They eschewed these activities at higher rates than did men and non-single women. Second, while unmarried women perform similarly to married women in class when their performance is kept private from classmates (on exams and problem sets), they have lower participation grades.

Now, she’s suiting up again to topple Germany’s latest data-retention law, passed last November, which requires phone and Internet providers to store call records, IP addresses and other identification records, without any suspicion of wrongdoing by users.

Privacy, a human right that is insidiously undermined by this new law,” she says during an interview. “I can’t just sit here and watch that. This is why I will do everything I can do to topple it.”

Victory! EU court rules that indiscriminate data retention is not permissible

Brussels, BE — Earlier today, Thomas von Danwitz, Judge Rapporteur of the Court of Justice of the European Union (CJEU), issued his judgment on the joint data retention cases known as Tele2 Sverige and Davis and Others. The outcome: EU member states may not impose a general obligation to retain data on providers of electronic communications services, and when law enforcement has access to retained data, they must ensure independent oversight mechanisms and remedy. This is a critically important victory for fundamental rights in the EU.

“This ruling reaffirms that existing general data retention schemes are not proportionate”, said Fanny Hidvegi, European Policy Manager at Access Now. “Member states are skirting an increasing amount of responsibility under various exceptions, be it ‘national security’ or ‘legitimate interest’. Access Now is pleased that the court did not embrace the false dichotomy of privacy versus security, and once again enforced the proper standards and explicit safeguards for fundamental rights. Judges engaged in ongoing cases all around Europe should follow the clear lines the court has drawn today against general data retention”.

On the Reason Why a Job Guarantee is Rejected in Favor of a Standalone Basic Income Guarantee

Da heisst es u. a.:

Consider the US Dollar. At its very essence, the US Dollar is just a number, and numbers, as we know, are infinite. A Dollar exists only in one of three forms:

1.) Numbers in a reserve account at the Federal Reserve
2.) Numbers in a security account, also at the Federal Reserve
3.) Cash – Federal Reserve notes and coins

The US Dollar is not just paper and metal coin. In fact, when it comes to federal spending, paper dollars have nothing to do with the subject. The federal government doesn’t print cash to fund its spending. Cash is but a physical manifestation of a certain number (1, 5, 10, 20, 50, 100) that was issued by the US Government. Today, paper US currency is issued to meet bank customers demand for cash. In other words, first the US Government spends by crediting bank accounts with numbers (1, 5, 10, 20, 50, 100). Those numbers sit on an electronic spreadsheet called a “reserve account”, and they move back and forth between reserve accounts held at the Federal Reserve, ensuring that payments clear. Bank customers demand cash, so the US Government (The Bureau of Engraving and Printing) prints paper dollars. When a bank like Chase requests $2 million in cash, the Federal Reserve deletes the number 2,000,000 from Chase’s reserve account and then ships $2 million in cash to Chase. Chase then sticks the $2 million in cash in its vaults and then hands the paper dollars to customers when they ask for cash. Put simply, the US Government converts numbers in reserve accounts into pieces of paper which enables bank customers to carry around that number and buy things.

The US Dollar is a monetary instrument.

 Das BGE dreht die Welt auf den Kopf. Gewöhnlich erbringt man erst eine Leistung und wird dann bezahlt. Das BGE hingegen wird vorab gezahlt. Dabei ist ein BGE als solches durchaus anwendbar in Verbindung mit der JG wie Neil Wilson zeigt.

Basic Income is based on the principle that people should be paid first and then perhaps do something later if they feel like it. That is a complete reversal of the principle of contribution that is in place in society. Everywhere else you have to be of service to others and put them in your debt first, before you receive anything of real value in return.

Yet there is no need to overturn the entire structure of the current economy. If those people who really believe in Basic Income want to put it in place under a Job Guarantee system then they can do so. Just endow a charity to give money to people. If the recipients then decide to work for others (perhaps working for the charity) they will receive the Job Guarantee wage which will then, in effect, end up being the advance payment for the following period rather than an arrears payment for the previous one.

A standalone Basic Income Guarantee without a Job Guarantee as “the” solution, is a steaming hot plate of status quo served with a side of status quo. There is simply nothing progressive about the Basic Income Guarantee when it is used in this manner. There is nothing intrinsically wrong with a Basic Income Guarantee at all. The initiative can easily be combined with a Job Guarantee, but politicians refuse the proposal, because the Job Guarantee pegs the currency to labor.

Pegging the US Dollar to gold means full employment for gold.
Pegging the US Dollar to British Pounds means full employment for the British Pound in the US.
Pegging the US Dollar to silver means full employment for silver.
Pegging the US Dollar to hamsters means full employment for hamsters.
Pegging the US Dollar to Kalamata olives means full employment for Kalamata olives.
And pegging the US Dollar to labor means full employment for humans.

Understand? Fantastic.

A Universal Basic Income, or a simple Basic Income Guarantee do not peg the US Dollar to anything. Essentially, they work to increase aggregate demand. They contain no inflation anchor, real or nominal. A Job Guarantee, on the other hand, actually pegs the US Dollar to labor. Human labor becomes the anchor for the currency, and as we now understand, should the US Government initiate a federal Job Guarantee, it would be pegging the US Dollar to labor, effectively forcing a situation of full employment in the United States. Now then, let us ask:

What’s one thing that corporate America, the 1% and Wall Street love more than anything?

US Dollars.

What’s one thing that corporate America, the 1% and Wall Street have a profound hatred for?

Full employment.

Der Gedanke, das resourcenreichste Bundesministerium mit einer App und Spenden einen Schraubenschlüssel in sein Getriebe werfend lahmlegen zu können, hat den umgekehrt proportionalen Unterhaltungswert einer lahmen Max Uthoff Schote. (2) Da hätten Alarmglocken angehen müssen.
3. Die vollkommen unreflektierten rechtlichen Vorraussetzungen, Implikationen und Restriktionen.

The Basic Income idea has some great marketing behind it and superficially appears to solve problems. Unfortunately the tricks used to promote it come straight out of the propaganda textbooks — attributing miracles to the policy when there are not justified.

The main trick is to compare an income guarantee to the broken system we have at the moment. The result is a miraculous increase in output. But that has nothing to do with the merits of Basic Income. It is just what would happen with any system of increased spending activity that knocks our monetary production systems out of the persistent slumps they always finds themselves in under ‘laissez faire’ conditions.

It’s only when you compare Basic Income with other managed economy schemes that the issues with it come to light.

 The rest of the economy will respond to the monetary stimulus and increase its output to its structural maximum, which for the purposes of this article we will assume is identical for both schemes. Whatever distributional outcome is required can be created in the Rest of the Economy via redistributive taxation, and the amount of stuff (goods and services) delivered to Participants is the same.

The difference is that the basic income scheme represents an extraction of goods and services from the Rest of the Economy, whereas the Job Guarantee represents an exchange of 37.5 Labour Hours per week for goods and services from the Rest of the Economy.

In other words the Basic Income participant gets paid twice in real terms. Once in terms of output from some part of the labour hours of the Rest of the Economy and once from their own 37.5 labour hours per week — which are self consumed.

Basic Income injects money into the Rest of the Economy, but without any increase in output available to others. So the total amount of money in the Rest of the Economy naturally chases fewer goods and services. If you are in the Rest of the Economy, you will end up getting less for your money. And we usually call that inflation, but perhaps it is really just a form of theft.

But, But, But

The argument then continues. Of course people are not going to self consume all their hours, but are going to go out into the world and do ‘good works’. But this is a fallacy of composition. There is no more likelihood of enough volunteer opportunities springing up than there are job openings — both due to the matching problem. Instead of hearing those in charge berating people to ‘start their own business’, we will hear them imploring people to ‘start their own charity’.

Since there is no active mechanism to create things to do that are of service to others, the amount available will converge at the usual suboptimal point and a section of the population will be left high and dry — regardless of their intent. Laissez faire works no better with activity than it does with money.

The Job Guarantee solves this by creating things to do. It takes activity to the people where they are and creates roles for the people as they are. If there is to be enough useful service available for everybody, it has to be produced with a managed process.

Exploiting others

The essential weakness of the Basic Income system is known, but hidden in platitudes. Many an article on basic income will highlight the ‘experiments’ that allegedly show wondrous benefits to the participating area.

Wenn die BaWü Staatsanwaltschaft sich zumindest dem Anschein nach der Strafanzeige gegen das ledige Fräulein Martina Musati, vormals GFin Jobcenter München, annehmen würde, wäre zumindest meine Illusion gekitzelt.

Guten Tag Herr xxx,

Meine tibetische (nicht deutsche, trotz deutscher Geburtsurkunde!) Tochter sandte am 10. Feb. 2016 eine Strafanzeige gegen die damalige GFin eines sozial-faschistischen Jobcenters, Frau Martina Musati und nun tätig bei der Agentur für Arbeit in Stuttgart, wegen Verstösse  gegen Art. 10 der Europäischen Konvention der Menschenrechte (EMRK), Artikel 5 GG, sowie § 226 BGB. Bislang bevorzugten Sie das Schweigen im Walde.

Ich schreibe heute in meiner Position als Vater, da meine Tochter berufstätig ist und häufig in Hotels europäischer Länder nächtigt und somit wenig Zeit findet, der deutschen Kasten-Justiz nachrennen zu müssen. Es mutet seltsam an, wie die teutonische Justiz ein auffallend verschlafenes Comportment zeigt bei der Strafverfolgung von staatlichen kriminellen Bediensteten, beauftragt mit der Durchsetzung von grundgesetzwidrigen Arbeitszwangsmassnahmen zur garantierten Bereitstellung wohlfeiler Arbeitskörper zum Zwecke der Profitmaximierung der deutschen Exportindustrie und gleichzeitiger Garantie steigender Armut weiter gesellschaftlicher Schichten.

Immerhin erdreistete sich diese besagte Person, mich zu erpressen, um einen kritischen Blog Post über ihre kriminelle und rassistische Kaschemme, firmierend unter dem Euphemismus 'Jobcenter', gelöscht zu sehen. Dabei wurde sie von der berüchtigten bayerischen Justiz, bekannt für neonazistische Affinität, auffallend gedeckt und geschützt ebenso wie ein Lümmel Namens Manfred Jäger, jetzt Chef der Agentur für Arbeit Ingolstadt. Ein Rechtsstaat geriert sich nach meinem Empfinden anders, aber old habits die hard.

Noch erstaunter bin ich ob Ihrer Untätigkeit, als doch die Justiz der Provinz Bayern bei mir und meiner Tochter gnadenlos und mit bewaffneten Polizisten zuschlägt, teils in Nazi Manier, in dem Irrglauben, meine kritischen Veröffentlichungen auf meinem Blog unterbinden zu können, ihn gar durch Computerbeschlagnahmen zum Verschwinden zu bringen.

Das perfide Unterfangen dieser Person Martina Musati, meine Tochter hinterhältig aus der Schule zu locken und in einen Pisser-Job zu verfrachten, getreu des bekannten deutschen institutionellen Rassismus und genüsslich dabei unterstützt durch die verrottete bayerische Justiz, die sich einen lächerlichen Oberstaatsanwalt Namens Hummer leistet, der sich dümmlich erdreistet, mir Kritik an Geschichtsverfälschungen von Sendungen im deutschen Langeweiler-TV über die Nazizeit zu verbieten. Dies nun laufend unter der Beschwerde Nr. 35285/16 beim Europäischen Gerichtshof für Menschenrechte.

Mittlerweile drängt sich auch der Verdacht auf, gestützt auf auffallende Indizien und chronologisch wahrscheinlich noch in die Amtszeit dieser Person Martina Musati in München fallend, dass sie Teil der perfiden Online Strafeinzeige gegen mich bei der Bayerischen Polizei am 07. Mai 2015 war. Diese Strafanzeige wurde unter falschem Namen abgesandt! Daraufhin wurde Ende Oktober 2015 unsere komplette IT-Ausrüstung beschlahnahmt. Nicht genug damit, die Polizisten nahmen auch mein Handy mit, obwohl es im richterlichen Beschluss zur Beschlagnahme nicht aufgeführt war! Es war auch eine Polizistin dabei, um meine Tochter zu durchsuchen und auch ihr Handy zu beschlagnahmen. Das sind Nazi Methoden und das Bundesverfassungsgericht hat klare Richtlinien zur Beschlagnahme von Handys in 2005 gegeben.

Ich würde mich freuen, wenn die BaWü Staatsanwaltschaft sich nun tunlichst zumindest dem Anschein nach der Sache annehmen würde. Tipp: die bayerischen Staatsanwälte hatten immer die Schablone  § 152 STPO als Reinwaschmittel zur Hand. Soweit ich mich recht erinnere, hatte der EGMR sich in einer seiner Entscheidungen befremdend geäussert, wenn ALLE Strafanzeigen durch die Justiz abgewiesen werden.

Diesen 'Resport to EUROPEAN COURT OF HUMAN RIGHTS on relentless infringements of free speech by German Jobcenter in collusion with Munich Court' hatte ich im Oktober an den EGMR gesandt. Er spiegelt, wie ich finde, herrlich die ganze Korruptkeit der Bananen Republik Deutschland wieder.
