In May/June 2018 I informed you about the unbelievable act of cowardice cum stupidity of the civil servant Jürgen Sonneck.

In typical German fashion you stayed quiet!

The Twitter account was immediately blocked by the Labor Ministry BMAS and the Ministry for Family Affairs BMFSFJ. Law suits are pending (1).

This Useful Idiot cum civil servant and creep Jürgen Sonneck had the ass-hatted idea to email police a criminal complaint against me in 2015, accusing me of alleged hate speech. In his foul and rotten manner he cowardly hid behind the false name “C. Paucher” in Nazi-secret-informer-style. Police and Munich Court did not investigate the IP address and instead covered everything up! Roland Freisler is in awe and extends a thumbs up. German neoliberal labor policy stops at nothing.

All our IT equipment was confiscated in Nazi style, smartphone without court order, house photographed. The laptop of my Tibetan daughter (which she needed for school) deliberately damaged by the conniving and rotten Munich Roland Freisler Court (2)!

After I blew the rotten creep’s cover, Jürgen Sonneck was swiftly shifted clandestinely and under cover of the night to the Department of Education and Sport Munich. The sordid criminal did not stop there. In 2018 he unsuccessfully tried to financially blackmail me via a lawyer chick demanding his name and picture not being published. My reference to two Federal Court BGH verdicts silenced the lawyer for good and she is probably tending some ducks in the park.

The Federal Civil Service Act (BBG) determines in § 60 the basic obligations of civil servants.

(1) Civil servants serve the entire people, not a party. They have to perform their duties impartially and fairly and to take care of the public good in their administration. Civil servants must admit their entire behavior to the liberal democratic basic order within the meaning of the Basic Law and advocate for its preservation.

§ 48 Civil Servants’ Status Act covers the ‘Duty to pay damages’.

Minister of Justice Barley mused in 2018 pompously "And we want to link the pact with a campaign for the rule of law: everyone has to understand that a rule of law can only work if its rules are respected, and we have to make it clear that legal recourse is open to anyone when it comes under public scrutiny sees his right injured.” (3) Go figure!

A continuation of your silence is not in congruence with the demands and expectations of a democratic state. It is, alas, a familiar habit of these Germans, not least steeped in post-Weimarian history.

I DEMAND THAT THIS FUCKING CRIMINAL JÜRGEN SONNECK FULLY REIMBURSES THE LAPTOP OF MY DAUGHTER AND IS DRAGGED INTO A COURT BY HIS REMAINING 78 HAIRS !

Lying and disreputable judges and prosecutors in Munich make me sick to my stomach. You may want to get in touch with the concerned authorities in the province of Bavaria and get the mess fixed, or at least a veneer of respectability established.

The latest decision from the Munich Roland Freisler Court (2), aka OLG Munich, with file number 4Ws 2/19 KL by the judges Dr. Koch, Hümmer and Dr. Lutz reeks to high heaven (Obstructing the course of justice - German Criminal Code 339).

I would definitely suggest you show the dignity to comment on this sordid matter, instead of hiding in embarrassing speechlessness and reticence.

What is next to be expected by rotten German civil servants? SWATTING?!

"The computer of his daughter was returned in a deliberately (!) damaged condition (clear scratches in the lower left quarter of the screen and a broken trackpad) by the Munich Court. Since it was unusable, the complainant sent it to the Federal Ministry f. Work and Social Affairs BMAS in January 2017. The MacBook was confiscated even though the daughter needed it for school. The then attorney of the complainant in a trial before the Munich court on May 6, 2015 which resulted in the ECHR Case 35285/16 warned in the presence of the daughter of the complainant literally that if the blog should be continued, "they will destroy you" (in German "machen die Sie fertig"). He was referring to the Munich Court."

A recent post on an upcoming case on the blog "Verfassungsblog.de" concluded:

"The upcoming decision will show if the ECtHR still deserves its titles as ‘guarantor’ of the Convention and ‘island of hope in stormy times’ or whether this island is drowning under the pressure of some of its Member States."

Open Email to the Federal Ministry for Family Affairs, Senior Citizens, Women and Youth re. Jobcenter Munich

Dear madam Family Minister Schwesig, 

The hallmark of your ministry has for some years now been the promotion of women in the business world and here it fits nicely that I am the father of a daughter of Asian-German descent. She was fortunate, thank goodness, not to have been born in Germany but in Asia and therefore, finding a nursery school for her was easy. We could even choose. 

Here in Germany my daughter trades under the not exactly auspicious label 'migrant', ie a term, as I have read in disbelief that, probably in a temporary state of mental derangement, is supposed to have been coined by the Federal Statistical Office. Well German history offers quite illustrious proof of inventive solutions for the classification and the selection of people. 

Due to her status as 'migrant' the assessment on the website of your ministry: 

"Teenagers and young adults from underprivileged families or young people with a migration background are by no means less talented than the average of their peers. However, for their social, educational and professional integration, they often need targeted support that is tailored to their individual life situation." 

finds my positive resonance, although the phrasing is a little unfortunate. I am also positively inclined to the efforts of your ministry: 

"With the initiative" STRENGTHEN the YOUTH ", the Federal Ministry for Family Affairs, Senior Citizens, Women and Youth, promotes the social, educational and professional integration of young people with special needs in the transition from school to work." 

In some agency however, which according to the Giessen Administrative Court tries to grace itself with a 'touch of authority' and is commonly known as trading under the somewhat euphemistic term 'Jobcenter', your laudable advances seem to be met with unrequited love. 

At aforementioned establishment a migration background is viewed with a certain doubt and suspicion which can only be dispelled by demanding - devoid of any legal basis - to see the intermediate school certificate. This dubious government agency for the provision of low-paying jobs does not in the least feel embarrassed to identify a migration background with a possible need for tutoring. This is all the more perplexing, when said institution had previously never shown any interest in the academic career of my daughter whatsoever and instead recently devised some impressive counter-measures. 

It seems that the Jobcenter misses no opportunity to venture into new mental lows. Some nosy person going by the name of Jean-Marc Vincent from the jobs department proffered his "help" to sign up my daughter to the third-rate jobs website of the Federal German Employment Agency in order to receive job offers. By way of this, the Jobcenter can snoop out her email address and mobile phone number in order to scour the social networks. It does not end here. By coaxing my daughter out of school and into a job this person can earn bonus points. The Jobcenter can just not accept that young people try to attain higher school education.

In this context, I believe the statement on the website of your ministry: 

"The target groups include, for example, young people with and without migration background who refuse to attend school or who are not reached by the school by the local actors and do the education, training, basic security and employment promotion." 

is rather addressed at the Jobcenter. It is pretty plain that this decrepit Agency for State-Guaranteed Poverty has but one single goal: coax young people out of school and into low-paying jobs 'By all Means'.

This assessment on the BMFSFJ site strikes me as un peu interpretable: 

"With the demographics of today's youth and future generations are growing importance and responsibility. Besides best promote and strengthen young people also need sufficient experience and design spaces and times to develop its own personality." 

Is it perhaps intended to be understood that it is conducive for the personal development of young people to feel their "growing importance" by proudly looking at already three law suits against said establishment in the first eleven months of reaching legal age?

Is it reinforcing personal "responsibility" in young people when they see their summer job pay stolen from said Center-of-Low-Wages?

Does one "develop ones own personality," by taking the Managing Director of this law-breaking institution as a role model when that manager touches the height of ridiculousness and seediness demanding the removal of a blog post or face a penalty of € 10,000? We treasure the right of free expression and will always fight for it.

Retrospectively my daughter and I can glance at "sufficient experience and Gestaltung spaces" this country has provided. So much, that my daughter will leave this low-wage country in the coming years. We also see not much value in her keeping German citizenship as the Comportement of Germany in its relationship to other countries in Europe is not shared by us. We are not inclined to approve wage deflation as a weapon against other Union countries and we find it deplorable to see hundreds of thousands of young people there in unemployment and lack of opportunities. It is not conducive to good karma.

PS: In a letter of the Munich public prosecutor I learned this week that, among other things, Job Center staff Jean-Marc Vincent (as I suspect) has brought an action for libel against me. He takes exception to be dubbed a "slimy employee" while engaging in activities outside the law.

Open email to the German Ministry of Education re. Jobcenter Munich

Dear Minister of Education Wanka, 

Recent events with an institution entrusted to guarantee low-wage jobs induce me to write to you in an open email. Allow me to quote from the home page of your ministry's website:

"The educational advancement of young people must not fail due to financial barriers." 

and on this page: 

"Education is the most important investment in the future. This is true for each individual and for society as a whole. Each child and every young person should receive the best possible educational opportunities in Germany, irrespective of their cultural or social origin or physical possibilities of his parents' house." 

Unfortunately this seems to have not yet transpired to the institution, which according to the Giessen Administrative Court strives to attain a 'touch of authority', and in this particular case the Jobcenter of Munich in the province of Bavaria. 

It is said Jobcenter, where I and my daughter, who has just completed her first eleven months of coming of legal age - meaning the age of majority according to the BGB and not the justice system SGB this questionable agency Jobcenter works on - and insofar as she is of Asian-German provenance, therefore consequently in those rather wooden German semantics runs under the term 'migrant' (is this perhaps a Baudrillardian simulacrum?) - feel compelled to notice, that "the most important investment in the future" is quite ostensibly viewed by this agency as rather a cost that must be avoided 'By all Means' including circumventing the law and arbitrary application of the law. 

Your Ministry of Education's website assesses correctly: 

"In Germany almost four million children are under the age of 18, more than a quarter of this age group in at least one social, financial and cultural risk situation, which detracts from their educational opportunities." 

yet said institution for State Guaranteed Poverty Management, aka Jobcenter, shows a startlingly inventive repertoire of counter-measures in such a consistent way of more or less persistent breaches of law with the impressive result that my daughter can already proudly look at three legal actions before the Social Court in Munich against this government institution.

It is shrouded in opaqueness for me as a parent what "positive means for their education" 
adolescents could distill out of these deeply questionable dealings of a government institution. A state should not be surprised by an emotional disassociation of young people and ultimately a decision to emigrate to better shores.

Would it not be wiser and certainly more honest, especially since the dealings of said agency are well-known since years, to even more circumvent the German basic law in Germany's quest for cheap labor and pass additional legislation perhaps stating along these lines:

"Children, who belong to the community of Hartz IV recipients, have the right to education up to secondary school. An education beyond this level would strain public finances and also overtax these children." 

This had the additional benefit for the Jobcenter Munich to legally continue breaking laws unabated, arbitrary application of laws, the refusal to cover the costs for the school bus and, last but not least for this seedy agency, stealing the pay of my daughter's vacation job.

It would also alleviate the managing director of the Jobcenter Munich, whose full name according to the Attorney General of Munich is Martina Monika Musati, of the plight to force me to take down a blog post or face a penally of € 10,000 (euro ten thousand in words) some two years ago. An endeavor that left me in a bout of raucous laughter.

Furthermore, it would render it unnecessary that a dude from that agency writes a slimy letter to my daughter demanding to see her school midterm card without any legal basis, connive to get her email address and mobile phone number and ultimately trying to coax her out of school and into a low-paying job. For good measure he manages to add a decent amount of discriminating prejudice by suggesting she might need some tuition.

I fully agree with the BMBF when it states: 

"Good education - from kindergarten to school, training and study through to education - is the key to participation and social advancement." 

Sadly this assessment is not being shared at the Jobcenter Munich. In their eminent offices everything is done to curtail a comprehensive education in order to meet their pre-established numbers and earn a bonus.

Of course this is understandable, when an institution can present such an elitist intellectual talent as its CEO Martina Musati, a lady of mind boggling eloquence and a commanding grasp of the German language, who manages on a sparsely printed DIN A5 page to repeat the word 'integration' ten times and subsequently sparked a learned discussion about redundancy in the republic that helped to bring about a paradigm shift. Wittgenstein can now sit back and relax.

RE. Discrimination attempt by the Jobcenter Munich against my daughter

Dear Madam, Sir, 

I hereby file a complaint about a discrimination attempt of the Jobcenter Munich against my daughter xxx. 

Prologue:

My daughter was born on 00/00/00 in Asia. Her mother is Asian and I am German. She is therefore identified in Germany under the somewhat crude term "person with an immigrant background." A term that itself raises the question of a potential discriminatory intent! My daughter has a German birth certificate and we lived until fall of 2005 in Asia where she also attended school.

After completion of the GCSE in 2013 in Munich, she is now attending a so-called FOS since the fall of 2013 in Munich. This education is expected to run until 2015; at full High School diploma until 2016. The Jobcenter is informed about this by a school certificate since the fall of 2013. 

Beginning of March 2014, exactly after the issuing of the school half-year report, my daughter received a letter from the Jobcenter Munich. She was asked among others to submit her school half-year report.

Furthermore, the clerk of the Jobcenter Munich suggested a signup with the federal employment agency of the BAA (an agency with a somewhat questionable reputation) going even so far as to offer his help in the signup: 

If you seek professional training and are not yet registered with career counseling (at the Employment Agency Munich), I will ensure your registration. To arrange this, contact me. The registration is very important for receiving notice of open apprenticeships. 

The sender of the letter held the job title 'Jobcenter Munich - Employment Agency U25'. 

Upon my email enquiry on the purpose of the submission of a school half-year report, I received the following response:

Good day Mr. xxx, 
thanks for your first reply. 
As part of my consulting contract in accordance with SGB II Contact I am the agency contact for your daughter xxx during the transition from school education to professional training or study. 
For tailor-made advice, I need some information on the current state (school report card), especially as to whether the desired degree is reached in the summer, or whether any private lessons, if required financed by the Jobcenter, should be offered. Therefore, I ask you or your daughter to submit to me the listed documents.

My daughter attends school and she is not looking for work! She also does not need any "help" to register with a third-rate job agency. This offer is used to help sniff out her email address and mobile phone number. With this data the Jobcenter and the BAA are able to illegally access personal and private information on the social networks (see press reports warning about this). It further constitutes a fundamentally unlawful interference with the free choice of employment guaranteed in the Basic Law of the Federal Republic of Germany.

It is striking how the Jobcenter tries to coax adolescents out of school and into low-wage jobs in blatant disregard of fundamental laws of the FR of Germany. The Jobcenter shamelessly exploits the understandable lack of legal knowledge of adolescents and migrants.

In addition, the Jobcenter seems to harbor prejudices against migrants when it comes to the purported necessity of private lessons. It is all the more baffling as the Jobcenter had never shown any interest in the development of my daughter.

The Jobcenter also seems to entertain doubts about migrants as to their ability to graduate in a higher school when it questions "whether the desired degree is reached in the summer".

The alleged "tailored consulting" is all the more hypocritical as the Jobcenter in all those years took absolutely no interest in the school progress of my daughter and knows nothing about her interests and talents.

The Jobcenter acts without any legal basis for the request of a school report. Two email enquiries with the Jobcenter Munich about the legal basis remained unanswered! The refusal of any willingness to communicate was underlined by headquarters of the Jobcenter Munich when they installed an email auto responder in May with the explicit message "Please note that your email will not be forwarded!" 

The Jobcenter proves once again the findings of racism and discrimination in Germany set out in publications such as: 

▪ Report of the United Nations - A/HRC/14/43/Add.2 on page 11, item 40 states selection by the three-tiered school system and under-representation of minorities in the German school system.

Epilogue:

I have lived a long time in Asia and my daughter fortunately did not grow up in Germany. At no time did we ever feel discriminated against in Asia. However, we have never experienced such racism and discrimination as in Germany.

My daughter will leave this country in a few years. She will also give up her German citizenship.

RE: "Free school transportation"

Synopsis of an email I have sent to the Department of Education and Sports of Munich. It is about how migrant young people are discriminated against in Germany and in Bavaria in particular. It also deals with the 'Low-wage-mafia-company' Jobcenter.

My daughter is attending a higher school since September 2013 in Munich, after she gained a secondary education certificate. Regrettably we found out that in Bavaria visiting a higher school does not entail the benefit of getting free school transportation right away. The tickets need to be prepaid and parents are only reimbursed at the end of the school year and this process can take up to three months. So in the worst case scenario you get your moolah after fifteen months.

Now if you compare this to a student who enters straight away a so-called 'Gymnasium' (you have to know Germans love to segregate and they have this ridiculous three-tired school system) and enjoys free school bussing, you see the difference and it is clearly discriminating.

When it comes to discrimination, Germans are good but Bavarians are unmatched. Not surprisingly they coined the term "Wer betrügt, der fliegt" (in German language it somewhat rhymes and means 'You cheat, you go') and coincidentally it came up just when the EU borders opened for Romanians and Bulgarians. Bavarians love their prejudices and they prefer to stay among themselves. Oh, and they are Catholics.

Back to the subject, which is discrimination in the school system and in particular discrimination against 'migrants'. What constitutes a migrant in Germany? Basically anybody with foreign roots living in Germany. In that sense Americans would be 100% migrants, that's how stupid this term is.

Back to good ol' Germany and here it is important to know:

Despite repeated recommendations from ECRI (the 'European Commission against Racism and Intolerance'), Germany Has quietly not ratified Protocol no. 12 to the European Convention on Human Rights. ( ECRI REPORT ON GERMANY , page 9)

In 2014 the ECRI published the following report which received only short shrift in the German press:

The enrollment rate of children of migrant background in pre-school facilities, the provision of support to them throughout their educational path and the number of them attending Gymnasium (the type of secondary education preparing pupils for university) are still insufficient. Teachers are three times more likely to recommend Gymnasium, if the child is from a higher socio-economic status, which is detrimental for children of migrant background.

ECRI recommends that the German authorities clarify and quantify, in the National Action Plan on Integration, the two aims of considerably increasing the rate of enrollment of children from migrant backgrounds in pre-school facilities and raising the standard of training and the educational and intercultural competences of child care workers and pre-school teachers; the Plan should also describe the measures which all Länder should undertake in order to achieve these two aims. 

87. The continuing split between children from migrant backgrounds and other children re-emerges when they move up to secondary education. The two lower secondary streams (Hauptschule and Realschule) are attended by twice as many children from migrant backgrounds as the Gymnasium, the third stream, which is still the elite school for the majority population.99 This is why ECRI encourages the authorities to provide children from migrant backgrounds, throughout their primary and secondary education, with the requisite linguistic and educational support for lasting educational success.

Here are my personal experiences in racist Germany:

The racist and discriminatory Jobcenter Munich engages in all imaginable ways of putting migrants at a disadvantage. The Jobcenter Munich resorts to everything that can put pressure on its "clients" (they really call them so), such as lies, slander and collusion!

In addition, they almost never respond to an email with an email but rather resort to letters to answer. This way they play for time and it makes it more tedious to properly file a communications thread.

They refuse to release payments by breaking Germany's basic law and Supreme Court judgments. If you don't go to court, they don't give a fuck.

It does not stop here. The rotten Jobcenter in Munich gets even so seedily low that it sends disgustingly slimy letters to my daughter in order to get her email address with which they then snoop around on social networks.

The Jobbenter Munich is so sleazy that it asks my daughter to send in the marks sheet, devoid of any legal basis. They then suggest students to consider leaving school and join a work place instead in low-wage jobs, as reported several times in the press.

It is just so fitting the most corrupt state in Germany, the province of Bavaria: racism and discrimination, an immigrant clean-up action at the Viktualienmarkt in 2013 with hordes of police, ethnic profiling by police officers in this ridiculous pheasant hunters uniform and observed several times by my daughter and addressed in the ECRI report on page 42 (45 . German Institute for Human Rights, "Racial Profiling" - Illegal human control of persons according to § 22 paragraph 1 a Federal Police Act, make recommendations to the legislature, courts, and police, 2013), racist and discriminatory staff at the Jobcenter in Munich.

I close with the points 13 and 14 ibid on page 40:

13. (§ 89) ECRI recommends that the authorities clarify and quantify, in the National Action Plan on Integration the objective of providing children from migrant backgrounds, throughout their school and university careers, the necessary individual support to realise their potential. Specification is required of the actions to be undertaken by the Länder to achieve this aim. 

14. (§ 93) ECRI recommends that the German authorities insert into the National Action Plan on Integration the objective, with measures to be taken, to combat the practice whereby children from higher socio-economic status are three times more likely than others to obtain favourable opinions on the continuation of their schooling at Gymnasium.

A veritable slap in the face of Germany, I would think. We have lived some fifteen years in one of the corruptest and poorest countries in Asia. BUT we have never had an experience of discrimination like in Germany! We have always been treated kindly in Asia and that is where the heart of my daughter lies, NOT Germany.

The Jobcenter Munich is involved in law-breaking measures, such as sniffing out email addresses of adolescents

The Jobcenter Munich is eager in getting its hands on email addresses of adolescents and connivingly steering them into dropping out of school and getting a low-paid job. 

Jobcenter Munich team member Jean-Marc Vincent made the following offer to my daughter (she attends school full-time!) in a pretty sycophantic email and letter: 

If you seek a professional training and not are yet registered in career counseling (at the Employment Agency Munich), I will make sure a registration for you. To arrange this, contact me. The registration is very important for sending the open apprenticeships.

It seems the Jobcenter is engaged in sniffing out email addresses of adolescents under the guise of offering unrequested assistance. This even in connection with the dubious Federal Employment Agency. 

Using the email address fucked-up company Jobcenter can then snoop around on Facebook for example and other social networks: 

The Federal Commissioner for Data Protection warns: 

Job centers can use social networks to collect data of their clients. (german language)

The Jobcenter Munich is so screwed up that it takes full advantage of adolescents in their often not comprehensive legal knowledge shamelessly and in a racist and discriminatory manner. A clear case for the Data Protection Commissioner. 

Even more interesting is how blatantly the Jobcenter ignores the Privacy Policy, because my daughter is a full-time student and has no business with the Federal Employment Agency as she is not looking for a job.
