Ist die Praxis der Beschluss­verfügungen verfassungs­widrig?

Das Bundesverfassungsgericht beanstandet in letzter Zeit immer mal wieder die Verletzung grundrechtsgleicher Rechte in Eilverfahren. Jüngstes Beispiel ist der Beschluss vom 28.09.2017, Az. 1 BvR 1510/17: Darin wird eine sozialgerichtliche Entscheidung aufgehoben, die der Vorsitzende alleine getroffen hatte, ohne die hierfür erforderliche besondere Dringlichkeit darzulegen.

Überträgt man die Ausführungen des Bundesverfassungsgerichts zur Begründung des Verstoßes gegen das Recht auf den gesetzlichen Richter auf die übliche Praxis in Zivilverfahren, einstweilige Verfügungen – entgegen dem Leitbild des § 937 Abs. 2 ZPO – ohne mündliche Verhandlung zu erlassen, könnte diese Entscheidung erhebliche Sprengkraft haben.

Ich erhebe hiermit

K L A G E

gegen Wilfried Hüntelmann - Postanschrift: Agentur für Arbeit München, 80304 München

wegen Verletzung des Artikels 6 Abs. 3 EMRK.

Begründung

Mit Schreiben, gesandt als Pdf per Email, vom 24. Okt. 2017 (siehe Anhang) bat ich den GF der Agentur für Arbeit Herrn Hüntelmann, Sorge zu tragen, dass mir das Telefontranscript eines Anrufs eines leitenden Angestellten seiner Agentur nach dem 27. Aug. 2012 getätigt mir bis zum 03. Nov. 2017 ausgehändigt wird. Die Brisanz dieses Telefontranscripts und die Hintergründe ergeben sich aus dem angehängten Brief. Herr Hüntelmann präferierte das Schweigen. Es war ihm vermutlich verborgen geblieben, dass Akteneinsicht Europa Recht ist. Er möge sich der Lektüre der Entscheidung des Europäischen Gerichtshof für Menschenrechte befleissigen:
CASE OF FOUCHER v. FRANCE
(Application no. 22209/93), STRASBOURG , 18 March 1997
Das Recht zur Akteneinsicht eines Beschuldigten ist Europarecht. Die Weigerung der StA, dem Beschuldigten bei seiner Verteidigung in eigener Person Akteneinsicht zu gewähren und Kopien aus der Akte zu erhalten, verletzt Art. 6 III, 7 I und I EMRK. Die Verweigerung der Akteneinsicht des Beschuldigten macht den Staat schadensersatzpflichtig, EGMR, Urt. V. 17.02.1997 - 10/1996/629/812.
Ich stütze meine Klage unter Bezug auf § 25 SGB X Abs. 1 Satz 1. Dort heisst es:
§ 25 Akteneinsicht durch Beteiligte
(1) Die Behörde hat den Beteiligten Einsicht in die das Verfahren betreffenden Akten zu gestatten, soweit deren Kenntnis zur Geltendmachung oder Verteidigung ihrer rechtlichen Interessen erforderlich ist. 
Wie aus Abs. 5 Satz 2 hervorgeht, ist die Zusendung in elektronischer Form möglich.
(5) Soweit die Akteneinsicht in eine elektronische Akte zu gestatten ist, kann die Behörde Akteneinsicht gewähren, indem sie Unterlagen ganz oder teilweise ausdruckt, elektronische Dokumente auf einem Bildschirm wiedergibt, elektronische Dokumente zur Verfügung stellt oder den elektronischen Zugriff auf den Inhalt der Akte gestattet.
Selbstverständlich fertigt eine der Professionalität verschriebene Polizei über solche Telefongespräche ein Transcript an! Dieses ist von mir mittels Email am 28. Juli 2017 an die Polizeiinspektion 45 als auch am 01. Aug. 2017 über Twitter an die @PolizeiMuenchen und Justizminister Maas erbeten worden. Mit Schreiben vom 01.08.2017 teilte mir jüngst die Polizeiinspektion 45 mit, meine Anfrage nach dem Telefon Transcipt sei an die Kriminalfachdienststelle K 44 weitergeleitet worden. Am 12. Sept. 2017 sandte ich eine Email an KOK Carstens mit der Bitte um Zusendung dieses Telefontranscripts. Erwartungsgemäss blieb das Ersuchen unbeantwortet

Wie es der Zufall will, veröffentlichte  die New York Times am 03. Nov. 2017 einen Artikel mit dem Titel "Germany's Central Bank backs study in role of Nazi crimes".
Dort heisst es u.a.:
"The  researchers  will  draw  on  foreign  central  bank archives  that  have  not  been  thoroughly  examined  before. During  the  occupation  of  Greece  by  Germany  and  Italy, for  example,  the  Reichsbank  helped  engineer  runaway inflation  that  wiped  out  the  value  of  the  local  currency and  created  a  famine.  Revelations  could  fuel  resentment in  modern  Greece,  where  many  people  blame  Germany for  the  austerity  policies  imposed  on  the  country  since 2010."
Das war exakt der Bezug meines inkriminierten Blog Posts in 2012 und dies bewog mich, am 05. Nov. 2017 auf meinem Blog zu fragen, "Did the German labor agency's Censorship Trio also want to hide the Nazi past of the early German Bundesbank?" Weitere englischsprachige Posts werden die kriminellen Machenschaften von JC München/Agentur für Arbeit München/Justiz/Polizei behandeln.

Ich bitte das Sozialgericht, sich meiner Klage anzunehmen, schliesslich stammt die zugrundeliegende Kommunikation von einer staatlichen Arbeitsbehörde, die auffällige Konnotationen mit Nazi Heinrich Himmlers 'Aktion Arbeitsscheu Reich' aufweist.

The last time we talked about Germany's Strafgesetzbuch law, specifically section 86a that prohibits the display of Nazi symbols, iconography, or historical figures with few exceptions, was when Ubisoft accidentally sent the country versions of a South Park video game chock full of swastikas. I feel much the same today about the law as I did then: I get why the law was created, but it's probably time for it to be retired. While the law does make room for Nazi symbols to be displayed for the purposes of art and education, too often those exceptions are either not actually adhered to in real-world examples, while those that might be able to fit their work within those exceptions don't bother trying, too chilled by the law that limits their speech. Coupling that along with the simple fact that German citizens who really want to see Nazi symbols don't have to work particularly hard to circumvent the law resolves the whole matter as being somewhat silly.

In Germany, the game looks a little bit different. Hitler’s iconic mustache—the previously popular toothbrush style that fell out of fashion after the war because of its unshakable association with the brutal Nazi dictator—has been removed, according to a video posted on YouTube by Censored Gaming that compares two versions of the same scene. (Spoiler alert: Elements of the scene will be described in the next paragraph.)

In this particular part of the game, Hitler walks into a casting session of American actors who are auditioning for a part in a Nazi-made film. Not only is his mustache gone, but the insignia on his robe is different. It’s difficult to make out in the video, but according to Kotaku, the German version removes Hitler’s initials. Instead of a black swastika in its usual place at the center of a giant Nazi flag hanging in the background, there’s a warped-triangle symbol. The mustache-less Hitler isn’t calledmein führer in the German version but rather mein kanzler, meaning “my chancellor,” or mein heiler, meaning “my healer.” It also replaces exclamations of Heil Hitler! with chants of mein kanzler.

The swastika has been replaced with that made-up, three-pronged symbol that some stateside gamers may have seen in trailers and marketing. Bethesda Softworks has used it rather than develop separate trailers or risk having one with the wrong imagery used over in Europe. (In the past, the use of licensed music has also meant  careful tiptoeing around the presence of Nazi symbology.)

Fans are ripping the bowdlerized dialogue and symbology.

“They should’ve just put a paper bag on his head with ‘Not hitler’ written on it,” said one YouTube commenter.

“They deprived us of a great story by removing the amazing voice acting (both English and German) and replacing it with a low quality dub that changes the narrative into a nonsensical, patronising mess and then having the gall to offer it to us thinking we wouldn't notice these obvious changes,” said one Redditor, who said he is German.

Then there is Kotaku. But back to Polygon where they write:

If Wolfenstein 2: The New Colossus was going to launch in Germany, and it did, some measure of censorship was to be expected. Nazi symbology and references aren’t just frowned upon there, they’re flat illegal.

Except, that they are NOT! They are welcome when they serve a purpose. This here was posted on BENTO, a youth website, of that yellow press, fake news magazine SPIEGEL.


It is an anti AfD post against a political party that managed to garner some 13% of the votes in the elections last September. It would be quite a stretch to call 13% of Germans Nazis. Yet any mud that could be gathered was thrown at them by the press.

Oh, you can even deny the Holocaust with the backing of Germany's Constitutional Court as long as you are in a small group!

An open letter concerning the upholding of the Rule of Law in the European Union

OPEN LETTER TO COMMISSION PRESIDENT JUNCKER AND EUROPEAN COUNCIL PRESIDENT TUSK cc. First Vice-President Frans Timmermans on upholding the rule of law in the European Union.

Dear President Juncker, dear President Tusk:

We are scholars, politicians, public intellectuals and members of the European Parliament writing to you with the following concern:

The European Union has proclaimed the Rule of Law principle and respect for fundamental rights and freedoms to be binding on its Member States (Articles 2 and 6 of the Lisbon Treaty). The EU’s leadership has been a staunch protector of these fundamental norms, most recently in countering the Polish government’s attempts to undermine the independence of judges as well as the Hungarian government’s actions to limit civil society and media freedoms.

However, we are deeply concerned that the EU’s governing bodies are condoning the violation of the Rule of Law in Spain, in particular regarding the Spanish central authorities’ approach to the 1 October referendum on Catalan independence. We do not take political sides on the substance of the dispute on territorial sovereignty and we are cognizant of procedural deficiencies in the organisation of the referendum. Our concern is with the Rule of Law as practised by an EU Member State.

The Spanish government has justified its actions on grounds of upholding or restoring the constitutional order. The Union has declared that this is an internal matter for Spain. Issues of national sovereignty are indeed a matter of domestic politics in liberal democracies. However, the manner in which the Spanish authorities have been handling the claims to independence expressed by a significant part of the population of Catalonia constitutes a violation of the Rule of Law, namely:

1/ The Spanish Constitutional Tribunal banned the referendum on Catalan independence scheduled for 1 October, as well as the Catalan Parliament session scheduled for 9 October, on grounds that these planned actions violate Article 2 of the Spanish Constitution stipulating the indissoluble unity of the Spanish nation, thus rendering secession illegal. However, in enforcing in this way Article 2, the Tribunal has violated Constitutional provisions on freedom of peaceful assembly and of speech – the two principles which are embodied by referendums and parliamentary deliberations irrespective of their subject matter. Without interfering in Spanish constitutional disputes or in Spain’s penal code, we note that it is a travesty of justice to enforce one constitutional provision by violating fundamental rights. Thus, the Tribunal’s judgments and the Spanish government’s actions for which these judgments provided a legal basis violate both the spirit and letter of the Rule of Law.

2/ In the days preceding the referendum, the Spanish authorities undertook a series of repressive actions against civil servants, MPS, mayors, media, companies and citizens. The shutdown of Internet and other telecom networks during and after the referendum campaign had severe consequences on exercising freedom of expression.

 3/ On referendum day, the Spanish police engaged in excessive force and violence against peaceful voters and demonstrators – according to Human Rights Watch. Such disproportionate use of force is an undisputable abuse of power in the process of law enforcement.

 4/ The arrest and imprisonment on 16 October of the activists Jordi Cuixart and Jordi Sànchez (Presidents, respectively, of the Catalan National Assembly and Omnium Cultural) on charges of sedition is a miscarriage of justice. The facts resulting in this incrimination cannot possibly be qualified as sedition, but rather as the free exercise of the right to peaceful public manifestation, codified in article 21 of the Spanish Constitution.

The Spanish government, in its efforts to safeguard the sovereignty of the state and indivisibility of the nation, has violated basic rights and freedoms guaranteed by the European Convention on Human Rights, the Universal Declaration of Human Rights, as well as by Articles 2 and 6 of the basic law of the EU (the Lisbon Treaty). The violation of basic rights and freedoms protected by international and EU law cannot be an internal affair of any government. The silence of the EU and its rejection of inventive mediation is unjustifiable.

The actions of the Spanish government cannot be justified as protecting the Rule of Law, even if based on specific legal provisions. In contrast to rule-by-law (rule by means of norms enacted through a correct legal procedure or issued by a public authority), Rule of Law implies also the safeguarding of fundamental rights and freedoms – norms which render the law binding not simply because it is procedurally correct but enshrines justice. It is the Rule of Law, thus understood, that provides legitimacy to public authority in liberal democracies.

We therefore call on the Commission to examine the situation in Spain under the Rule of Law framework, as it has done previously for other Member States.

The EU leadership has reiterated that violence cannot be an instrument in politics, yet it has implicitly condoned the actions of the Spanish police and has deemed the actions of the Spanish government to be in line with the Rule of Law. Such a reductionist, maimed version of the Rule of Law should not become Europe’s new political common sense. It is dangerous and risks causing long-term damage to the Union. We therefore call on the European Council and Commission to do all that is necessary to restore the Rule of Law principle to its status as a foundation of liberal democracy in Europe by countering any form of abuse of power committed by Member States. Without this, and without a serious effort of political mediation, the EU risks losing its citizens’ trust and commitment.

The crisis has in the meantime developed further (the Catalan government was detained, arrest warrant was issued against Mr Puigdemont). We follow closely the situation with the interests of democracy in Catalonia, Spain and Europe in mind, as they cannot be separated, and we insist all the more on the importance for the EU to monitor the respect of fundamental freedoms by all parties.

There are fundamental rights of every human being that exceed the rights of constitution. Had the same action occurred outside the EU, Jean-Claude Juncker, Donald Tusk, and Mariano Rajoy would have been among the first in line to take a position.
