Anregung für das Jester Ensemble, aka Bundesverfassungsgericht, aus Karlsruhe von der AfD

Jeder kennt das Gesabber dieser selbstgefälligen Typen im lächerlichen Rot, "... wird nicht zur Entscheidung angenommen ..."und das noch auf billigstem Papier.

Entwurf eines Sechsten Gesetzes zur Änderung des Bundesverfassungsgerichtsgesetzes
(Gesetz zur Einführung der Begründungspflicht)

A. Problem
In Deutschland steht es jedem Bürger frei, sich bei einer Verletzung seiner Grund- rechte nach Erschöpfung des Rechtsweges mit einer Verfassungsbeschwerde ge- mäß § 90 Abs. 1 Bundesverfassungsgerichtsgesetz (BVerfGG) an das Bundesver- fassungsgericht zu wenden. Das Bundesverfassungsgericht hat bei der Einschät- zung, ob es die Verfassungsbeschwerde zur Entscheidung annimmt, einen weiten Beurteilungsspielraum. Es nimmt eine Verfassungsbeschwerde gemäß § 93a BVerfGG nicht zur Entscheidung an, soweit ihr keine grundsätzliche ver- fassungsrechtliche Bedeutung zukommt, wenn es nicht zur Durchsetzung der in § 90 Abs. 1 BVerfGG genannten Rechte angezeigt ist, oder wenn dem Beschwer- deführer durch die Versagung der Entscheidung zur Sache kein besonders schwe- rer Nachteil entsteht. Der Nichtannahmebeschluss ist nach § 93d Abs. 1 Satz 2 BVerfGG nicht anfechtbar. Er muss gemäß § 93d Abs. 1 Satz 3 BVerfGG außer- dem nicht begründet werden. Die Nichtannahme einer Verfassungsbeschwerde ohne Begründung soll das Bundesverfassungsgericht aufgrund einer über Jahre angestiegenen Anzahl von Verfassungsbeschwerden vor einer übermäßigen Ar- beitsbelastung schützen und seine Funktionsfähigkeit erhalten.

Die aktuelle Rechtslage ist das Ergebnis eines jahrzehntelangen Reformprozesses, durch den der Handlungsspielraum der Richter des obersten deutschen Gerichtes hinsichtlich der Annahme oder Nichtannahme schrittweise erweitert und zugleich der ihnen auferlegte Rechtfertigungsdruck verringert wurde. Mit der Gesetzesno- velle von 1963 (vgl. BGBl S. 589) und der Einführung des Annahmeverfahrens wurde der Begründungszwang für die Nichtannahme abgeschafft. Für die Begrün- dung des Beschlusses der Nichtannahme genügte nunmehr ein Hinweis auf den für die Ablehnung maßgeblichen rechtlichen Gesichtspunkt. Das Mehr oder We- niger an Begründung blieb dem pflichtgemäßen Ermessen des Richters überlassen (vgl. BT Drs. 4/1366). Im Änderungsgesetz von 1985 (vgl. BGBl S. 2227) wie- derum wurde das Erfordernis der Begründung akzentuiert, indem der „maßgebli- che rechtliche Gesichtspunkt“ dargelegt werden musste. Mit der Novelle von 1993 (vgl. BGBl S. 1442) entfiel das Begründungserfordernis im Interesse einer Entlastung des Bundesverfassungsgerichtes vollständig. In dem Maße, wie der Handlungsspielraum des Gerichtes erweitert wurde, wurde das Schutzinteresse der Bürger jedoch eingeschränkt. Der frühere Hinweis auf die maßgeblichen Gründe der Nichtannahme wurde mit der 5. Novelle von 1993 (vgl. BGBl S. 1442) vollends fallengelassen, sodass die Nichtannahme nicht mehr begründet werden muss. An dieser Verfahrensweise hat sich erhebliche Kritik entzündet.

Die vollständige Befreiung von der Begründungspflicht hat zur sog. Praxis des „leeren Blatts“ geführt: Die Kläger erfahren nur mehr den Verweis auf die gesetz- lichen Grundlagen über die Nichtannahme ihrer Klagen zur Entscheidung, ohne jedoch Anhaltspunkte für die fehlende Relevanz oder die nicht evidente Grund- rechtsverletzung zu erhalten. Berechtigterweise führt solch eine Praxis zur weit verbreiteten Ansicht, dass es sich bei der individuellen Klagebefugnis des § 90 Abs. 1 BVerfGG um ein „ausgehöhltes Recht“ handele, das jedermann zwar wahrnehmen könne, allerdings keine Bedeutung entfalte. Durch die fehlende Be- gründung der Nichtannahme wird das Recht der Verfassungsbeschwerde syste- matisch entwertet. Entsprechend ist die Anzahl abgewiesener Verfassungsbe- schwerden seit der 1993-Novelle angestiegen. Die Begründung der Nichtan- nahme von Beschwerden vermeidet nicht nur das Misstrauen der als Verlierer hervorgegangenen Prozesspartei, sondern ebenso das der gesamten interessierten Öffentlichkeit.

Die Aufhebung der Begründungspflicht lässt sich als Verstoß gegen das Rechts- staatsprinzip verstehen, das sich darin ausdrückt, dass Entscheidungen begründet und nachvollziehbar sein müssen, damit eine Kontrolle des Staatshandelns ge- währleistet bleibt. § 93d Abs. 1 Satz 3 BVerfGG steht deswegen im Widerspruch nicht nur zur Begründungspflicht des § 30 BVerfGG, der dem höchsten deutschen Gericht aufträgt, seine Entscheidungen schriftlich abzufassen, zu begründen und von den Richtern, die daran mitgewirkt haben, unterzeichnen zu lassen. Urteile des Bundesverfassungsgerichtes ergehen im Namen des Volkes und müssen zwin- gend aus diesem Grund durch das Volk kontrollierbar und nachvollziehbar sein, was deren Begründung voraussetzt.

Merkel's immigration policy a net positive for childbearing

Chided at home for her immigration policy, Merkel gets support from a scientific study. First some facts.

"With a value of 1.50 in 2015, however, it is still far from the replacement level fertility of 2.1 children per woman."

Hang on, here comes good news for Merkel's Germany courtesy Martin Fieder and Susanne Huber and their study 'Evolution and Human Reproduction'. The replacement level fertility of 2.1 children per woman may be met in coming years.

According to that study,
... Those studies based on representative data sets from modern societies clearly demonstrate that particularly personal income is positively associated with the number of children in men but not in women, where the association is mostly neutral or even negative (Fieder et al., 2005; Hopcroft, 2006, 2015; Weeden, Abrams, Green, & Sabini, 2006; Nettle & Pollet, 2008; Fieder, Huber, & Bookstein, 2011; Barthold, Myrskylä, & Jones, 2012; Fieder & Huber, 2012). The position in a social hierarchy is also positively associated with offspring number in men but not women (Fieder et al., 2005; Fieder & Huber, 2012).
IOW, men with higher income tend to have more children. Not so women.
In most cases, this positive relationship between socioeconomic status indicators and offspring number was explained by the higher chance of low-status men to remain unmated and, thus, childless.
So poor men have difficulties finding a mate and thus remain out of the "child production" cycle. Now here comes the kicker.
In society subsets, however, not only does the risk of childlessness increase among men of low income but also the number of children increases in those who reproduce at all (Fieder et al., 2005).
Though poor males are left behind, those who do find a spouse fornicate like rabbits. One can not help but give Merkel credit for this ingenuity. After all, she is a scientist herself.
This may be particularly important in societies at risk of disintegration into subsamples—for instance, in the case of high immigration. Although income provides a rather “universal status indicator” (Fieder, Huber, & Bookstein, 2011), in immigrants, some status indicators could have a different meaning because migrants may partially use the partially deviating status system of their home society.
It may not be disintegration that immigrants are facing in Germany, but the country does not have a good track record in integrating foreigners. The status indicator of their home society is often the number of children for they provide social security in old age. There you go, Germany.

Let's turn to religion and the fact that the new German Interior Heimat Minister Seehofer from the deep woods of Bavaria stated in his first speech that 'Islam is not a part of Germany'. I am not sure he reflected that properly, but then again, he hails from the province of Bavaria where clocks tick differently. He might break out a cold sweat when reading:
A particularly high degree of homogamy has been found for religion (Fieder & Huber, 2016), as well as education (Huber & Fieder, 2011). An analysis of census data from IPUMS International (https://international.ipums.org/international) reveals a worldwide mean in religious homogamy of 94.82%. The highest prevalence of religious homogamy is found in the Muslim world (usually >99%), in which the Quran ensures the rate of high homogamy (Quran, 2:221, 5:5, 60:10), ...
He may even be more shocked to hear about the prospects.
Marriage stability and satisfaction may in turn affect fertility decisions. Indeed, religiously homogamous couples have a significantly lower chance of remaining childless but a higher average number of children, even controlling for religious intensity (Krishnan, 1993; Fieder & Huber, 2016).
He may even be close to a heart attack when the study found "a cultural trait may represent an expanded “kinship system” that may have evolved during the aggregation to larger social units". The prospect of a religion-based dichotomy is not particularly enticing for staid, traditional Germans. The AfD says hello.
The clear pro-fertile effect of religious (Fieder & Huber, 2016) and, to a lesser extent, educational homogamy (Huber & Fieder, 2011, 2016) indicates that there may also be evolutionary reasons for the high prevalence of homogamous mating. From an evolutionary standpoint, marriage along a cultural trait may represent an expanded “kinship system” that may have evolved during the aggregation to larger social units. In the case of religious homogamy, for instance, despite the fact that a certain proportion of religious homogamous marriages can be expected among kin, individuals may recognize other individuals of the same religion “as somehow closer,” sharing at least some essential values. A comparable mechanism may also hold true for educational homogamy, albeit educational homogamy represents a much younger “mating system.”
Dichotomy sounds much more benign than a "breakup of societies into “parallel societies,”", yet that may be in the cards.
In times of global mass migrations, the high prevalence of religious homogamy, together with its reproductive effects, may also have far-reaching implications because it may lead to the breakup of societies into “parallel societies,” which is why efforts to integrate migrants will be demanding.
It is also to be doubted that Germans will subscribe to an “inclusive fitness perspective”, let alone a "religious and cultural groups mix". Mention the suggestion to "reproduce across group boundaries" to the majority of Germans and you might see open revolt in the streets, almost certainly mayhem in East Germany.
From an “inclusive fitness perspective” (Hamilton, 1964), integration will be successful if religious and cultural groups mix—that is, reproduce across group boundaries. In the case of such mixed reproduction, cooperation is expected to be high regardless of the cultural group to which the relatives and those related by marriage belong: Via their offspring, their grand-offspring, and subsequent generations of descendants, they share genes in common.
The AfD and strata of German society will ensure "the very strong “biological ties” of cooperation" and "sustainable social cohesion" albeit to the detriment of shitlib political parties.
Therefore, if cultural groups mix, the very strong “biological ties” of cooperation ensure sustainable social cohesion. Accordingly, these newly arising “mixed groups“ may form new minimal endogamous sets in subsequent generations (Whitmeyer, 1997) in which cooperation may be high. Genetic data suggest that this process may have often occurred during human evolution and migration (Patterson et al., 2012).
The future's so bright for Germany, you might want to wear shades.

Are Germans plain nuts by default, or is their political correctness just a temporary bug?

Gone are the blessed days when you could call these delicious calory bombs 'Negerküsse' (negro kisses) and nobody would raise an eyebrow. These days, uuh, even your girl friend might reprimand you. Still, to this day and beyond they are Negerküsse to me!

With that in mind, things got a little heated some days ago in Mutti-Land when an AfD politician tweeted about a son of the German tennis legend enquiring whether the "kleine Halbneger" (small half-negro) was getting the necessary attention. That is showing a remarkable concern for the well-being of young Noah which happens to be his name, but the Germans did not see it that way.

"After the AFD Bundestag member Jens Maier has noticed in the short message service Twitter with a racist commentary on Noah Becker, he could now face legal consequences. According to reports of the "Bild" newspaper Becker wants to take legal action against Maier in consultation with his father. Beckers lawyer Christian-Oliver Moser told the newspaper that he had been instructed to "take immediate and necessary criminal and civil action against Mr. Jens Maier for this clearly racist Twitter message."
Leading politicians from the SPD , the Union, the Greens and the Left reacted with sharp criticism to the Tweet Maiers, in which Boris Becker's son Noah was called a "little half-negro". Maier referred to a statement by Noah Becker with his message. The artist and musician said in an interview that Berlin is a "white city" compared to London or Paris. He himself had already been attacked for his skin color.
Twitter deleted the comment that had already been published on Tuesday; The "Bild" newspaper documented it with a screenshot. According to the newspaper, the commentary on the 23-year-old Becker son is: "The little half-negro just seems to have been given too little attention, otherwise his behavior can not explain."

It has created an uproar all over the media. Lawyers are at it. I could not quite follow because the young fellow is clearly not white (oops), but the enquiring mind gifted to me guided me first to Der Duden to see what they had to say about the word 'Neger'.

The term Negro is considered to be highly discriminatory in public usage and is therefore avoided. Alternate names are colored, colored and black, black; the latter name is z. For example, in reports on South Africa, they are likely to be used more frequently, in order to be able to refer more clearly to the black population (as in contrast to Indians). People with dark skin living in Germany often choose the self-named Afrodeutscher, Afrodeutsche, which is increasingly being used.

Well, thank you so much. That was quite  a mouthful. So after having been extensively informed now, I gather the AfD politician should have rather adressed young Noah as 'half-black'. This, however, would create a problem. Suppose you go to a men's shop to buy a suit in the color half-black. You would get quite some dumbfounded looks from the salesperson.

There is simply no color going by the name half-black. A half-black would rather be a dark gray or lighter anthracite. OK, we want to be politically correct and foremost not racist. Should the AfD politician have addressed him as 'little gray Noah' or perhaps better 'little anthracite Noah'? Er, hello Germany???

Things to ponder in Mutti-Land. Anyway, it's all right, I'm jumpin' jack flash; It's a gas, gas, gas; Ooh!

I am concerned about German Justice Minister Heiko Maas' grasp of grammar, in particular punctuation.

I am a little concerned about the German Justice Minister Heiko Maas. Yes, the NetzDG douchebag from Saarlouis. Not because he always makes an insecure impression when Merkel is around. He just is insecure. Just look at that photo at the end.

No, it is his grasp of grammar and in particular punctuation. He does not seem to be familiar with the functions of a comma, let alone commata. However, he is on a mission.

It so happened during New Year's night that the police of Cologne (was there what two years ago?) shot off a tweet in Arabic wishing a Happy New Year. They did not tweet the same wishes in Japanese, although quite some live in and around nearby Dusseldorf. Neither in Hindi, nor any African language for that matter. Which is kind of odd and smacks a little of attitudinizing.

In this scenario , a member of the AfD political party shot off a tweet in a reaction to that tweet in Arabic from the police. Hours later her Twitter account was suspended based on the NetzDG which went into effect on, you guessed it, Jan. 1, 2018. Oh, ze Germans are efficient.

and in English:
"... because the last thing I want to have is soothing barbarian, Muslim, gang raping men!"
Let's get back to smarty ass Heiko Maas who has never for a day worked as a lawyer. I would bet my non-existing Lambo on it, he has never read Wittgenstein:
"On the other hand it seems clear that where there is sense there must be perfect order. So there must be perfect order even in the vaguest sentence."
The Heiko could learn something about the function of the comma here.  Is the ridiculous minister sure the adjectives are coordinate?

Now with this in mind, let's get back to the AfD politician's sentence. It can as well be understood as to mean:

"... because the last thing I want to have is soothing barbarian men, Muslim men, gang raping men."

Would that be hate speech, you bloke of a minister?

Hundreds of complaints have been filed and the prosecutor is investigating for, hold your pants, SEDITION!

The case is fucking dead in the water!

Germany finds itself in a fickle state as it is unable to build a new government. New elections have to be avoided at ALL costs; the AfD would win even more votes and Merkel be dead in the water, the SPD in the teens and smarty ass back in Saarlouis.
